Judge rules Virginia elections board violated law with late absentee mail-in ballot rule

Last August, the Virginia Board of Elections issued a rule that would’ve allowed elections officials to count late mail-in ballots that arrived without a postmark up to three days after the November election. On Monday, a state judge ruled that the board’s decision was illegal.

Virginia Circuit Court Judge William Eldridge said that Virginia’s mail-in ballot rule violated state elections law and issued an injunction preventing the state from adopting the rule for future elections, the Daily Caller reported. The judge’s decision was announced by the Public Interest Legal Foundation (PILF), a legal group representing Frederick County electoral board member Thomas Reed in his case against the state mail-in ballot law.

“This is a big win for the Rule of Law,” PILF President and General Counsel J. Christian Adams said. “This consent decree gives Mr. Reed everything he requested – a permanent ban on accepting ballots without postmarks after Election Day and is a loss for the Virginia bureaucrats who said ballots could come in without these protections.”

The Virginia Board of Elections issued its election guidance to county boards on Aug. 4, 2020, notifying them that any ballots “received by the general registrar’s office by noon on the third day after the election … but does not have a postmark, or the postmark is missing or illegible” were not to be rendered invalid. But a week later, the elections board decided that such ballots should be counted.

On Oct. 13, PILF filed a lawsuit against the state elections board on behalf of Reed, who argued that he would not enforce the directive because it violated state law.

The relevant Virginia statute states: “Any absentee ballot returned to the general registrar after the closing of the polls on election day but before noon on the third day after the election and postmarked on or before the date of the election shall be counted.” Reed’s lawyers argued that a plain reading of state law prevents ballots that lack a postmark from being counted.

Two weeks later on Oct. 28, 2020, the court sided with Reed in a preliminary injunction hearing, issuing an order that prevented the state of Virginia from accepting and counting late absentee ballots that were missing postmarks.

The result is that none of the contested ballots were counted in the November election and Judge Eldridge’s final ruling siding with Reed over the Virginia elections board will not change the outcome.

The ruling, however, will apply to future elections in Virginia, including the November 2021 gubernatorial and state legislature elections.

Pennsylvania mail-in ballots show Trump underperforming state GOP candidates and Biden overperforming state Democrats

Conservative Review senior editor Daniel Horowitz raised concerns about the margin of former Vice President Joe Biden’s lead in mail-in votes in Pennsylvania, discussing the results with BlazeTV host Mark Levin on his Fox News program, “Life, Liberty, and Levin” Sunday night.

Horowitz, the host of the “Conservative Review Podcast,” said that the official results show President Donald Trump underperforming other elected Republicans statewide and Biden overperforming his fellow Democrats in mail-in ballots. He says the results are concerning because the margins for Biden don’t make sense.

The 2.6 million mail-in votes cast in Pennsylvania, “always seemed to skew against Trump even relative to other Republicans and they always seemed to favor Biden even relative to other Democratic candidates,” Horowitz said.

“When you take a look at Republicans who won their races for state auditor, for state treasurer, it turns out that those Republicans did better than Trump on mail-ins but not on Election Day,” he explained. “On Election Day they had fewer votes than Trump. Whereas, when you go to the Democrat victors, such as Dan Shapiro, the notorious attorney general, he seemed to do better than Biden on Election Day ballots but worse than Biden on mail-ins.”

“In other words, Biden always won out on mail-ins and Trump always got fewer votes,” he concluded.

“So what you’re saying is Biden out-performed everyone including fellow Democrats on the mail-ins in a significant way and President Trump underperformed statewide Republicans on the mail-in ballots in a significant way,” Levin asked.

“Exactly,” Horowitz replied. “When you look at other states we’re finding a similar pattern of a bunch of ballots cast that only had Biden, and of course, they’re always mail-ins.”

Horowitz noted that “naysayers” may argue that some people are only interested in the presidential race and may have only filled out their mail-in ballots for president, ignoring down ballot races.

“But the problem with that is, why would you see this asymmetry in Pennsylvania where even within Republican voters it seems that more of them filled out ballots for mail-ins down ballot … but then when you go over to the Democrats it seems like more Democrats filled out down ballot Election Day but not on the mail-ins,” he said.

Based on his analysis, given that 64.7% of mail-in votes in Pennsylvania were from registered Democrats, 23.7% from Republicans, and 11.6% from nonpartisan or other party voters, Horowitz estimated that even if Biden won 95% of returned mail-in ballots from Democrats, 21% from Republicans, and 80% from independents, he still wouldn’t have reached the number of mail-in ballots he reportedly received when the votes were counted.

“That gap is something we have never seen before,” Horowitz said.

In Pennsylvania, witnesses raised many issues, among them:

  • Attorney and poll witness Justin C. Kweder: “96% of the board workers were processing mail-in ballots 15 to 200 plus feet from us… The observers were not able to challenge any decision or determination being made about the processing of these mail-in ballots.” Plus, “The observers were informed that the board was going to be duplicating damaged mail-in ballots that could not be read by the scanners. I was told that there were more than 5,000 of these damaged ballots.”
  • Canvasser Kim Peterson: As the mail-in ballots were being opened, the witnesses were kept at a distance of at least “20 feet, about, and you could not see, at all, the envelope, the ballot itself, where they were stacking them, anything that was required that we were able to see.” Moreover, the monitors provided for viewing were “pathetic,” “fuzzy,” and “looked like they were using old technology.”
  • Poll watcher Leah Hoops: “What became of concern was the back room, which had no observers, no line-of-sight or transparency into the process… We were granted five minutes every two hours… The setup was sitting in a chair 20 feet from any physical ballot.”
  • Navy veteran and forensic computer scientist Gregory Stenstrom: “As an expert in this, I think it’s impossible to verify the validity of about 100,000 to 120,000 votes… What I saw, as a forensics expert, was an election process that was forensically destructive in the manner it was conducted with the envelopes being separated from the ballots and going to the other side of the room.”

What we are now seeing as likely is that President Trump will look to hedge his bets by announcing that he’ll run again in 2024, while campaigning in Georgia in the weeks ahead, in an effort to secure the Senate for Republicans.

This raises the likelihood that the White House will push Mitch McConnell to put a bill on the floor to help avoid the eviction crisis that’s sure to come in January, without rent relief.

Trump won’t want to announce his presidential race for 2024, while millions of people face evictions and a government shutdown puts one million more employees on leave and many households on the street.

We believe that the White House is pushing for a bridge stimulus bill until the president is finally announced by the electorates and the courts.

We’re now seeing a remarkably-unsustainable market rally and, in my opinion, any negative developments which are not priced in, and any positive news which is already priced-in and doesn’t go above and beyond, could prick this balloon.

Keep your eyes this week on the sales data from Black Friday and Cyber Monday, along with talks from the White House about the need to pass stimulus and the 2021 budget. If Trump wants to leave office (should he need to) on a positive note, strong and popular, with hopes of running again in 2024, he’ll want to do it as a hero.

The markets will celebrate this type of behavior big-time; the bubble could have 10% more to go — S&P 500 at 4,000 points could be just around the corner.

Pennsylvania Supreme Court rejects GOP challenge after judge said it had ‘likelihood to succeed’

The Pennsylvania Supreme Court struck down a lawsuit late Saturday that challenged the legality of a new state law that allowed voters to obtain an absentee ballot for any reason.

What’s the background?

As TheBlaze reported, Commonwealth Judge Patricia McCullough issued an injunction last Wednesday after Republicans made an emergency request to stop the certification of Pennsylvania’s election results.

The central claim of the lawsuit was that Act 77, a law passed in Oct. 2019, violated the state constitution by allowing voters to obtain absentee ballots for any reason. The state constitution, on the other hand, specifies only a limited number of reasons for which an absentee ballot may be cast.

McCullough later issued an opinion on Friday explaining that the petitioners would likely win on the merits of their case.

Petitioners appear to have established a likelihood to succeed on the merits because Petitioners have asserted the Constitution does not provide a mechanism for the legislature to allow for expansion of absentee voting without a constitutional amendment. Petitioners appear to have a viable claim that the mail-in ballot procedures set forth in Act 77 contravene Pa. Const. Article VII Section 14 as the plain language of that constitutional provision is at odds with the mail-in provisions of Act 77. Since this presents an issue of law which has already been thoroughly briefed by the parties, this Court can state that Petitioners have a likelihood of success on the merits of its Pennsylvania Constitutional claim.

What did the state Supreme Court say?

The Pennsylvania high court — which is controlled by a 5-2 Democratic majority — unanimously dismissed the lawsuit, ruling the challenge came too late for a reasonable legal remedy.

The lawsuit had asked for the absentee ballots cast as a result of Act 77 to be invalidated.

“Upon consideration of the parties’ filings in Commonwealth Court, we hereby dismiss the petition for review with prejudice based upon Petitioners’ failure to file their facial constitutional challenge in a timely manner,” the Pennsylvania Supreme Court wrote in a three-page opinion.

In fact, the court said the lawsuit violated the “doctrine of laches” because of the petitioners’ “complete failure to act with due diligence in commencing their facial constitutional challenge, which was ascertainable upon Act 77’s enactment.”

The court explained:

The want of due diligence demonstrated in this matter is unmistakable. Petitioners
filed this facial challenge to the mail-in voting statutory provisions more than one year
after the enactment of Act 77. At the time this action was filed on November 21, 2020,
millions of Pennsylvania voters had already expressed their will in both the June 2020
Primary Election and the November 2020 General Election and the final ballots in the
2020 General Election were being tallied, with the results becoming seemingly apparent.
Nevertheless, Petitioners waited to commence this litigation until days before the county
boards of election were required to certify the election results to the Secretary of the
Commonwealth. Thus, it is beyond cavil that Petitioners failed to act with due diligence
in presenting the instant claim. Equally clear is the substantial prejudice arising from
Petitioners’ failure to institute promptly a facial challenge to the mail-in voting statutory
scheme, as such inaction would result in the disenfranchisement of millions of
Pennsylvania voters.

Meanwhile, Chief Justice Thomas Saylor and Justice Sallie Mundy filed a concurring and dissenting opinion suggesting that the constitutional merits of the case — that Act 77 may violate the state constitution — could be considered by a lower court at a different time. They agreed, though, that the current petitioners acted far too late.

Saylor and Mundy are the court’s two Republican justices.

Pennsylvania judge rules GOP lawsuit challenging new absentee ballot law has ‘likelihood to succeed’

The Pennsylvania judge who temporarily halted the certification of election results in the Keystone State issued an opinion Friday explaining that the Republican plaintiffs in her case will likely win on the merits of their lawsuit.

As TheBlaze reported, Commonwealth Judge Patricia McCullough issued an injunction Wednesday after Republican lawmakers made an emergency request to stop certification of the state’s election results over concerns about Act 77, a new law that allowed Pennsylvania voters to obtain an absentee ballot for the election for any reason.

The plaintiffs argue Act 77, which was signed into law in October 2019, wrongfully overrides the stipulations for absentee balloting established by the state’s constitution. The Pennsylvania Constitution states absentee ballots can be cast by those who cannot go to polling locations due to a work obligation, sickness, religious holiday, or “election day duties.”

As a result, the suit asks the court to prevent the certification of election tallies that include mail-in ballots resulting from the expanded rules of Act 77, and further moves to have the Pennsylvania General Assembly assign the state’s electors.

What is the judge saying now?

McCullough explained in a 13-page opinion that the plaintiffs are likely to succeed in their lawsuit because Act 77 appears to violate the Pennsylvania state constitution.

“Petitioners appear to have established a likelihood to succeed on the merits because Petitioners have asserted the Constitution does not provide a mechanism for the legislature to allow for expansion of absentee voting without a constitutional amendment,” McCullough wrote.

“Petitioners appear to have a viable claim that the mail-in ballot procedures set forth in Act 77 contravene Pa. Const. Article VII Section 14 as the plain language of that constitutional provision is at odds with the mail-in provisions of Act 77,” she continued.

“Since this presents an issue of law which has already been thoroughly briefed by the parties, this Court can state that Petitioners have a likelihood of success on the merits of its Pennsylvania Constitutional claim,” McCullough said.

Anything else?

According to WESA-FM, Gov. Tom Wolf (D) and Secretary of State Kathy Boockvar have appealed to the state Supreme Court to intervene. Democrats currently hold a 5-2 majority on the Pennsylvania high court.

Meanwhile, Ed Morrissey noted at Hot Air that the “laches” doctrine could apply in this case, thereby hurting the plaintiffs’ argument, because they did not raise objections before or after Pennsylvania’s June 2 primary, which used the same absentee system as the general.

“Having raised no objection before the election, the plaintiffs have participated in the alleged violation, which would impact their standing to demand relief,” Morrissey explained.

That’s a good thing,” he added. “The challenge is, for President Trump to prevail, he’s got to run the table. He’s got to win, not just in one state but in several states. That makes it a lot harder to prevail in the litigation. I hope that he does so, but it is a real challenge and we shouldn’t try to convince ourselves otherwise.”

Election officials rejected fewer mail-in ballots in 2020 than in previous elections

In this clip, Pat explained that mail-in ballot rejection rates plummeted for first-time mail-in voters this year. States like Georgia, Michigan, and other swing states saw fewer rejections despite the increase in ballots cast by mail.

In a video posted Tuesday evening, Richard Hopkins, a United States Postal Service worker in Pennsylvania who said voter fraud was rampant denied taking back his statements when speaking to authorities. “I’m here to say I did not recant my statements. That did not happen,” said Richard Hopkins, standing against the mainstream media’s allegations.

The plan to say Hopkins recanted is backfiring, but it was probably one last-ditch effort by Democrats to maintain control of public perception about the outcome of the election, which should not have been called according to Real Clear Politics.

According to The New York Post, congressional Democrats and a major US newspaper claimed had recanted his allegations of mail-in-ballot tampering is denying that he walked back his words.

Hopkins is standing against the lying and propagating mainstream media.

Hopkins’ allegations — first reported by conservative activist group Project Veritas — were included in a federal lawsuit filed Monday by Trump’s campaign.

The suit alleges that Keystone State officials created “an illegal ‘two-tiered’ voting system” that unfairly favors mail-in ballots and “encourages ballot fraud or tampering.”

“It has been reported by Project Veritas, in a release on November 5, 2020, that carriers were told to collect, separate and deliver all mail-in ballots directly to the supervisor,” the suit says. –The New York Post

Biden Gains On Trump In PA, Takes Lead In Georgia, As Day Three Of Post-Election Counting Continues

As we head into day three of counting the ballots, Philadelphia City Commissioner Al Schmidt told CNN he expects an update in the next few hours as they kept counting through the night.

There are 50,000 votes left to be counted there, he said. Despite a dustup that was the result of observers from both the Trump and Biden campaigns have been present observing the counting process, Schmidt said. “We have no doubt when the count is finished, Senator Harris and I will be declared the winners” he added.

In Georgia, Biden took a lead of more than 900 votes at about 0430 Friday morning: the lead has since grown to 1,096 votes. He gained the lead initially came after Clayton County in the Atlanta suburbs reported a bucket of ballots. Biden had been winning a huge proportion of the votes in that area. Other Atlanta suburbs are still reporting.

In PA, Trump’s lead stood at 18,229 votes at 0600ET though it seems to steadily be shrinking. More mailed-in ballots, which Biden is winning by a healthy margin, are still expected to be counted, with many of them from the heavily Democratic city of Philadelphia and its suburbs. More mailed-in ballots are also set to be counted on Friday in Allegheny County, the home of Pittsburgh.

However, in Georgia, a local reporter summed up the situation with all the attendant frustration and vitriol. Robin Kemp, the reporter in Clayton County, acknowledged that “yes” the votes are still being counted” and that no clear winner has emerged.

If, by some miracle, Biden does pull off a victory in Georgia, it would be a historic moment for Dems. But it wouldn’t necessarily translate to a victory: Also, for readers who aren’t familiar with the other votes that take days to fully count these are validly cast ballots, just being counted now.

Biden also retains leads in the states of Nevada and Arizona, where ballots are still being counted, and mail-in ballots from thousands of older retirees remain to be counted.

With PA remaining the biggest available prize, every major network has Biden leading with at least 253 electoral votes, meaning that if he were to win Pennsylvania and its 20 electoral votes, he would have more than the 270 electoral votes needed to win the presidency. Fox News and the Associated Press have both called the race for Biden in Arizona, projecting him as the winner of that state’s 11 electoral votes, though other networks have abstained.

President Trump warns of ‘violence in the streets’ after losing court rulings on mail-in votes in Texas and Nevada

President Donald Trump warned on Monday that a court ruling against his administration would result in “violence in the streets” over mail-in balloting.

“The Supreme Court decision on voting in Pennsylvania is a VERY dangerous one,” tweeted the president.

“It will allow rampant and unchecked cheating and will undermine our entire systems of laws. It will also induce violence in the streets. Something must be done!” he added.

Trump was referring to a ruling in October by the court allowing mail-in ballots to be counted as long as they are postmarked by Election Day, even if they are delivered as late as Friday.

The president blasted the mail-in balloting rules in a speech Monday to his supporters in Scranton, Pennsylvania.

“When the Supreme Court gave you an extension they made a very dangerous situation, and I mean dangerous, physically dangerous, and they made it a very, very bad,” Trump said.

“They did a very bad thing for this state,” he added. “They did a very bad thing for this nation. You have to have a date. You can’t extend dates.”

Rulings in Texas and Nevada

The president also might have on his mind two other similar rulings in Nevada and Texas on Monday.

A federal judge ruled against the petition from Hamilton County Republicans
to toss out more than 127,000 ballots in Harris County, where the heavily Democratic city of Houston is located. Party officials argued that ballots had been collected through an illegal expansion of curbside voting. A judge disagreed and ruled the votes should be counted.

A judge in Nevada made a similar
ruling against the Trump administration and the Nevada Republican Party who argued that counting of mail-in ballots should be halted to avoid fraud.

“There is no evidence of any debasement or dilution of any citizen’s vote,” said Nevada Circuit Court Judge James Wilson.

Hours after the ruling in Texas, Republicans filed an appeal at the 5th Circuit Court of Appeals.

Pennsylvania rejects 372,000 mail-in ballots, leaving many voters confused: report

In the immensely critical battleground state of Pennsylvania, approximately 372,000 mail-in ballots were rejected. The situation perplexed many voters, but officials say there is an explanation for the confusion.

ProPublica and the Philadelphia Inquirer co-published a report on Friday discovering that 372,000 mail-in ballots were rejected. Overall, one out of every five requests for mail-in ballots were rejected, according to the report.

However, 90% of those mail-in ballots, about 336,000, were denied as duplicates. The reason for the confusion is because people may have previously and unknowingly already requested a mail-in ballot for the November election.

Many Pennsylvanians who voted during the June primaries may have checked a box to request a mail-in ballot for the November election. Many may have requested a second ballot unwittingly.

The attempt to promote mail-in voting in June amidst the coronavirus pandemic has caused administrative headaches for election officials preparing for the general election.

“We basically have to treat them all the same,” Bill Turner, acting elections director for Chester County, said. “We’re taking a tremendous amount of staff time and effort only to find out it’s a duplicate.”

“The volume of calls we have been getting has been overwhelming,” Marybeth Kuznik, elections director in Armstrong County, northeast of Pittsburgh, said. “It has been almost like a denial of service attack at times because it seemed that sometimes all I could get done was answer the phone!”

Making matters even worse, nongovernmental election groups have deluged Pennsylvania voters with mail-in ballot applications, urging voters to request mail-in ballots. Some voters assume these applications are from the state. They may think that their request for a mail-in ballot was not received by the government, so they request another mail-in ballot.

A spokesperson for the Pennsylvania Department of State said these nongovernmental election groups have caused “confusion for voters and the likelihood that voters will not realize their application has been processed and they don’t need to submit another one.”

“Voters have also been baffled by unclear or inaccurate information on the state’s ballot-tracking website, and by a wave of mail ballot applications from political parties and get-out-the-vote groups,” the report stated. “County offices across the state have been forced to hire temporary staff and work seven days a week to cope with the confusion.”

The report found that there were hundreds of voters who submitted three or more duplicate applications. One voter was alleged to have submitted 11 duplicates.

There are concerns that the confusion over the mail-in ballots could lead to voter disenfranchisement.

Over 2.7 million Pennsylvanians have requested mail-in ballots for this election.

Also this week, nearly 30,000 mail-in ballots in Pennsylvania were sent to the wrong residences. “About 28,879 voters in Allegheny County, home to Pittsburgh, were impacted due to an error made by Midwest Direct, the company tasked with printing, collating and mailing the ballots,” as reported by Fox News.

The inaccurate mailed ballots were a result of a mapping error. Correct ballots began mailing out on Thursday.

Earlier this week, over 100 mail-in ballots were found in a Kentucky dumpster. An investigation was opened by the U.S. Postal Service Office of the Inspector General, which led to a U.S. Postal Service employee being terminated.

California man finds dozens of mail-in ballots discarded in alley trash cans

A California man is sounding the alarm bell after he found dozens of mail-in ballots mysteriously stuffed inside two Santa Monica trash cans.

The shocking discovery comes as the 2020 presidential election is well under way in terms of absentee and mail-in ballots. Voting by mail took newfound prominence in the national dialogue over the summer as leaders looked for safe methods of conducting a national election amid the COVID-19 pandemic.

Many Americans, therefore, have chosen to cast their vote via mail-in ballot, which Republican critics say increases the possibility of voter fraud.

What are the details?

Osvaldo Jimenez told KABC-TV that he made the alarming discovery last Thursday. Stuffed inside a Santa Monica trash can, Jimenez discovered dozens of official ballots, along with other personal mail items, such as bank statements.

“I opened the trash can, and I see a lot of envelopes and ballots, especially ballot envelopes in the trash can, and I knew right away that was not normal,” Jimenez said. “I thought it was somebody playing a prank. Nobody’s going to throw ballot envelopes in the trash can.”

Jimenez’s wife posted pictures of the trashed ballots on social media, KCBS-TV reported.

According to KABC, Jimenez recovered the ballots and phoned police.

“If it was my ballot in there, I would want somebody to, you know, recover it,” Jimenez told KABC. “Every vote counts, whichever party it is.”

Shockingly, Jimenez later discovered even more mail-in ballots in a separate trash can, KABC reported.

How the ballots ended up in the trash cans is not clear. Law enforcement is investigating the incidents, as is the United States Postal Service.

Anything else?

As mail-in ballots play a greater role in the election than they ever have before, there have numerous stories of suspicious activities happening with mail.

For example, the U.S. Postal Service is investigating an incident that happened in Glendale, California, last month in which massive bags of mail were mysteriously dumped in a parking lot.

Then, just last week, a New Jersey mail carrier was arrested after police say he dumped thousands of mail pieces he was supposed to deliver. Among the pieces of discarded mail were 99 ballots.

Meanwhile, an investigation was launched in Virginia last week after six USPS collection boxes were broken into, sparking new fears that mail-in ballots could be compromised or stolen.

Election officials nationwide, however, say that despite mail-in ballots playing a significant role in this year’s election, the integrity of the election will not be compromised.

Texas mayoral candidate charged with 109 felonies related to mail-in ballot voter fraud

A mayoral candidate of a small town in Texas has been charged with 109 felonies over a fraudulent scheme involving mail-in ballots.

Zul Mirza Mohamed was arrested on Thursday and charged with 25 second-degree felony counts of unlawful possession of ballot or a ballot envelope without the request of a voter, and 84 third-degree felony counts of fraudulent use of mail ballot application.

Sheriff Tracey Murphree of the Denton County Sheriff’s Office said in a press release that they were tipped off about “possible fraudulent activities with absentee ballot applications” by the Denton County Elections Office.

They found that absentee ballots were requested to be sent to a P.O. box by voters in a Carrollton nursing home. When they contacted those voters, they said that they had not requested absentee ballots.

Investigators then found that the P.O. box had been obtained through the use of a false Texas driver’s license, and a false student identification card from the University of North Texas.

They then surveilled the P.O. box and installed an undercover agent. Investigators witnessed a suspect pick up the ballots on Wednesday, and obtained a search warrant for their residence.

Law enforcement officials there discovered the mail ballots and the fraudulent driver’s license used to obtain the P.O. box. They arrested Muhamed and charged him with the 109 felony counts.

“I want to commend all the investigators and agencies involved in this investigation,” said Sheriff Murphree.

“Voter fraud is a serious and widespread issue and cannot be tolerated. The fact an actual candidate for public office would engage in these activities is appalling,” he added. “We will continue to aggressively investigate allegations of voter fraud.”

Mohamed was running to unseat the current mayor, Kevin Falconer, of Carrollton. It was unclear to which political party Mohamed belonged.

He ran against Falconer in 2017 as well, during which his past criminal behavior became an issue in the campaign. He received 167 votes in that election, or 2.4% of the total votes.

Here’s what President Trump was referring to when he said fraud has been ‘established’ with mail-in voting

President Donald Trump said during Tuesday night’s first presidential debate that fraud has already been “established” as a risk with mail-in voting, citing a recent race between two Democrats.

What are the details?

As the debate began to wrap up, Trump pushed back on Democratic presidential nominee Joe Biden’s claim that “no one has established at all that there is fraud related to mail-in ballots. That somehow it’s a fraudulent process.”

“It’s already been established,” the president replied. “Take a look at Carolyn Maloney’s race,” Trump suggested to moderator Chris Wallace. “Look at Carolyn Maloney. They have no idea what happened.”

President Trump was not able to elaborate as Wallace returned the floor to Biden, who said that the president “has no idea what he’s talking about.”

What President Trump was referring to was a June primary race between incumbent Rep. Carolyn Maloney (D-N.Y.) and her challenger, fellow Democrat Suraj Patel.

Patel did not concede for more than two months, because, according to India West, the “results were delayed and contested due to problems counting absentee ballots.” Neither of the candidates alleged fraudulent or duplicate voting, but they did allege that some ballots were improperly not counted.

Fox News reported last month that the Maloney-Patel race and another New York race “mired by thousands of missing and uncounted mail-in ballots” have “become Exhibit A in President Trump’s campaign against universal mail-in balloting, which he and several experts say poses a major fraud risk.”

The outlet explained:

Maloney held onto a mere 658-vote lead over Patel after in-person voting concluded, with 65,000 mail-in votes uncounted. The final, certified margin of victory was 3,700 votes. A total of 13,000 mail-in votes were tossed out for various reasons, including missing signatures or incorrect postmarks.

President Trump called for a do-over in the Maloney race, referring to it as a “total disaster.”

Fox News also reported that “fraud has not been alleged in the race,” but acknowledged that “a Fox News analysis found a slew of issues in other states in recent days, including intentional ballot fraud.”

In reaction to Trump bringing up the Maloney race as an example, Patel tweeted Tuesday night, “Let’s be clear, the issue in my race was disenfranchisement, not voter fraud. More than 1 in 5 ballots were discarded, many multiples of the final margin. We called our election a canary in the coal mine for November, we were right. Trump lied about what happened here.”

Maloney herself did not address the fraud allegations when she tweeted, “Donald: I won my election. You’re going to lose yours.”

DOJ: Seven military mail-in ballots cast for President Donald Trump found discarded in Pennsylvania

The United States Department of Justice says a small number of mail-in ballots cast by members of the military for President Donald Trump were thrown away in Pennsylvania.

A federal investigation into reported problems with a handful of mail-in ballots received by the Luzerne County Board of Elections began Monday at the request of District Attorney Stefanie Salavantis. A statement from the U.S. attorney in charge of the investigation released Thursday announces that physical evidence was uncovered that some ballots were discarded.

“Since Monday, FBI personnel working together with the Pennsylvania State Police have conducted numerous interviews and recovered and reviewed certain physical evidence. Election officials in Luzerne County have been cooperative,” the statement from U.S. Attorney David Freed reads.

“At this point we can confirm that a small number of military ballots were discarded,” Freed said.

Investigators said nine discarded ballots were discovered, and seven cast for President Trump.

“Some of those ballots can be attributed to specific voters and some cannot,” Freed said. “Of the nine ballots that were discarded and then recovered, 7 were cast for presidential candidate Donald Trump. Two of the discarded ballots had been resealed inside their appropriate envelopes by Luzerne elections staff prior to recovery by the FBI and the contents of those 2 ballots are unknown.”

The investigation remains ongoing.

“It is the vital duty of government to ensure that every properly cast vote is counted,” Freed said.

Trump has frequently criticized mail-in voting, arguing states are not equipped to handle large volumes of mail-in votes and suggesting that widespread fraud and a “rigged” election would occur if states adopt universal mail-in voting.

“Mail ballots, they cheat,” Trump said in August. “Mail ballots are very dangerous for this country because of cheaters. They go collect them. They are fraudulent in many cases. They have to vote. They should have voter ID, by the way.”

Most recently, the president has not said he would commit to a peaceful transition of power if he loses the election, suggesting his loss would be the result of fraudulent ballots.

“We’re going to have to see what happens. You know that I’ve been complaining very strongly about the ballots, and the ballots are a disaster,” Trump said. “Get rid of the ballots, and you’ll have a very peaceful — there won’t be a transfer, frankly. There will be a continuation.”

After a media firestorm and several Republicans implicitly condemned Trump’s comments, White House press secretary Kayleigh McEnany clarified Trump’s remarks during a news conference Thursday, saying he would accept the results of a “free and fair election.”

“The president will accept the result of a free and fair election,” McEnany said. “He will accept the will of the American people.”

She defended his criticisms of mail-in ballots.

“To move the entire country to mass mail-in voting all at once and have an entirely new system, and do that in just a few short months is an untenable and unworkable proposition,” McEnany said. “And one that is shown to not work well at all.”

McEnany promised reporters she would provide proof that mail-in ballots for President Trump were discarded in Pennsylvania, presumably referring to the U.S. Attorney Freed’s statement released later that day.

Attorney General William Barr has also been a forceful critic of universal mail ballots.

“This is playing with fire. We’re a very closely divided country here. And people have to have confidence in the results of the election and the legitimacy of the government, and people trying to change the rules to this, to this methodology which, as a matter of logic is very open to fraud and coercion, is reckless and dangerous and people are playing with fire,” Barr said on CNN’s “The Situation Room with Wolf Blitzer” on Sept. 2.

Critics of the president and his administration say studies have shown that voter fraud is extremely rare and that previous attempts by the administration to show evidence of widespread fraud failed to do so.

However, there are examples of voter fraud conducted on a larger scale in the United States. In June, charges were filed against four New Jersey men, including two Paterson City officials, for allegedly engaging in voter fraud with mail-in ballots. More than 3,000 ballots in a Paterson City Council election were reportedly set aside over fraud concerns, with over 800 being invalidated. One incumbent councilman won reelection by just eight votes.

The Stage Has Been Set For The Most Chaotic Election In U.S. History

If you are deeply concerned about what is going to happen in November, you are definitely not alone.  Experts on both sides of the political spectrum have been warning that it is very likely that we will not know the winner of the presidential election until well after November 3rd, and everyone pretty much agrees that the period of uncertainly that we will be forced to endure will not be good for our nation.

Those of us that are old enough clearly remember the pain that the election of 2000 caused.  The outcome hinged on the results from the state of Florida, and the endless recounts were finally brought to a conclusion after 36 very stressful days with George W. Bush up by just 537 votes.  Unfortunately, some are saying that we are potentially facing “the 2000 election on steroids” because vote counting will be going on in multiple swing states long after election night is over.

The big reason why this election is going to be so different from previous elections is because so many Americans are going to be voting by mail.  According to one recent survey, a whopping 37 percent of all voters plan to cast their votes by mail this time around…

Thirty-seven percent of registered voters said they are likely to vote by mail in the November election, by receiving a mailed ballot and either mailing it back or returning it in person, according to a new survey released Tuesday by the Democracy Fund + UCLA Nationscape project.

Other estimates put the number as high as 40 percent, and it could go even higher than that because some states are promoting mail-in voting extremely aggressively.

In fact, as I detailed yesterday, one of my readers told me that he and his wife “have received three requests each for mail-in ballots” over the past five weeks.

We are also being told that Democrats are far more likely to vote by mail than Republicans are.  According to the same survey that I quoted above, supporters of Biden are more than twice as likely to vote by mail than Trump supporters are…

Among them, 48% of voters who plan to vote for Democratic presumptive nominee Joe Biden said they are likely to vote by mail, according to the survey. That’s more than twice the 23% of voters backing President Donald Trump who said they are likely to vote by mail.

It takes a lot of time to open and count ballots that have been mailed in.  If that work could be done in advance, that wouldn’t be that much of a problem.

Unfortunately, there are 14 states where it is prohibited by law to count mail-in ballots before Election Day, and that includes some of our most important swing states

Tens of millions of Americans will try to vote by mail because of the COVID-19 pandemic. But officials in 14 states are prohibited from processing mail-in ballots until Election Day; counting them could take days or weeks.

Those states include Pennsylvania and Michigan, battlegrounds that could decide the election.

It should deeply alarm all of us to hear that it “could take days or weeks” for some of these states to finally count every single ballot.

And that is just the first count.  I am not even talking about any potential recounts.

At this point, many Democrats are warning of a possible “red mirage” on the night of the election.  Many of them believe that it will look like President Trump is winning on election night, but that Joe Biden will ultimately win once all of the mail-in votes are finally counted.

As evidence, they point to the fact that there has been a “blue shift” in all national elections going back to 2004

Since 2004, mail-in ballots have been disproportionately Democratic, a phenomenon known as the “blue shift.”

So, barring a landslide, we could see a “red mirage” on Nov. 3, an election-night count of in-person votes that suggests that Trump has won — even though millions of votes for Biden are waiting to be tabulated.

Personally, I do believe that it is very likely that President Trump will be leading on the night of the election, but what is really going to matter is what happens during the days that follow.

If a Trump lead evaporates and Biden is eventually declared the winner, there will be widespread allegations that the election was stolen, and that could cause tremendous explosions of anger.

And the big tech companies are already preparing for post-election chaos.  In fact, Facebook has openly announced that they will purposely “restrict the circulation of content” in order to try to control civil unrest…

Facebook announced this week that it may restrict certain aspects of its platform following November’s general election as part of a larger effort to limit social unrest. A spokesperson for Facebook suggested that executives including Sheryl Sandberg and Mark Zuckerberg may censor specific information if they believe it is likely to heighten political tensions following the election.

According to a report by the Financial Times, Facebook announced this week that it will “restrict the circulation of content” following November’s election to curb violence and social unrest. The announcement follows efforts by Facebook to address concerns from those who have alleged that the platform aids in voter suppression and promotes election-misinformation.

What is this country going to look like if it takes weeks or even months to officially declare a winner?

No matter who ends up winning, I believe that the process is so flawed that it is going to tear the country apart.

And no matter what the final result is, a large percentage of the population will never accept the outcome as being legitimate.

This is already one of the most difficult chapters in U.S. history, and a bitterly contested election result will only make things even worse.

At this point, even the mainstream media is admitting that we are heading into “wild” times.  The following comes from CNN

Ask anyone about the next six weeks and they will likely give you some version of this as a response: Whoa boy. It is going to be wild.

Which it is! The last 42 days of a presidential election are always filled with unpredictable storylines, big moments and, more than anything, uncertainty.

Just about the only way that we can avoid the type of scenario that I have described is if there is an overwhelming landslide on election night.

Wouldn’t that be nice if that actually happened?

It would be wonderful if one of the candidates conceded on November 3rd or November 4th and we could avoid weeks or even months of endless national strife, but I don’t think that is going to happen.

Instead, I believe that both sides are going to fight to the bitter end, and the end will definitely be very bitter indeed.

Glenn Beck warns: The left is using mail-in voting to ensure election chaos, incite ‘civil war’

The Daily Beast recently reported on a group of 50-plus leading progressive organizations that calls itself the Fight Back Table or FBT, who are planning for a “post-Election Day political apocalypse scenario.”

The FBT held a meeting on Zoom to launch an initiative they dubbed the “Democracy Defense Nerve Center.” Meeting participants prepared for expected threats to a fair election in November, such as “armed right-wing militia dudes show[ing] up in polling places,” or poll locations that “mysteriously close” on Election Day. They also predicted that President Donald Trump would claim victory regardless of November’s election results, which would lead to inevitable “mass public unrest.”

“It is very obvious that Trump is laying the groundwork for claiming victory no matter what … we will fight to protect [our democracy] from what we truly see as a president who has gone off the rails and taking this country down an authoritarian fascist path,” said MoveOn Executive Director Rahna Epting.

On the “Glenn Beck Radio Program,” Glenn argued that the left is using large-scale mail-in voting — which unlike absentee ballots does not require voters to submit an application ahead of the election — to set the stage for chaos, revolution, and ultimately cause civil war to destroy our nation.

“No one will believe the [election] outcome because they’re changing the way we’re electing a president this time. And people don’t understand the difference … this is Democratic states just printing ballots and mass mailing them,” Glenn said.

“They’ve been war-gaming this forever,” he continued. “And the media is trying to make it look as if the right is the one that is violent. We’re not planning anything to happen on Election Day, except to go and vote. The chaos that’s coming, I think is remarkable. And if the DOJ doesn’t get involved and find out who these groups are and what they have planned, you are going to have intimidation and chaos the week of the voting, and for weeks [afterward] until we go into civil war. This is not hyperbole. This is what the left is now saying.”

Georgia secretary of state says 1,000 people double-voted in Georgia primary, suggesting that mail-in voting is in fact fraught with risk

Georgia Secretary of State Brad Raffensperger confirmed Tuesday that 1,000 people voted twice in the state’s primary election in June, a felony criminal act that he hopes will be prosecuted to the fullest extent of the law.

The alleged double voters returned absentee ballots and then also showed up to vote in person on Election Day, Raffensperger announced, according to the Atlanta Journal-Constitution.

“A double voter knows exactly what they’re doing, diluting the votes of each and every voter that follows the law,” the secretary of state said during a press conference. “Those that make the choice to game the system are breaking the law, and as secretary of state, I will not tolerate it.”

The Journal-Constitution noted that approximately 150,000 people who had requested absentee ballots ended up voting in person on Election Day.

The large majority reportedly never received their absentee ballots in the mail or simply decided to vote in person instead. But 1,000 both returned their absentee ballots by mail and successfully had their in-person votes tallied by poll workers.

Why does it matter?

The news comes as debate rages on in the country over mail-in voting and the potential for fraud ahead of the general election in November.

Democrats have insisted upon implementing large-scale mail-in voting due to health concerns as a result of the coronavirus pandemic. But several Republicans, including President Trump and Attorney General William Barr, have suggested that doing so would unnecessarily open up the election to potential widespread voter fraud.

President Trump even encouraged North Carolinians last week to test the integrity of the system by voting via mail-in ballot and then voting in person, as well, which is precisely what happened in Georgia.

Despite critics’ attempt to portray the president’s comments as election coercion, it appeared his intent in suggesting the action was simply to prove that the system was fraught with risk. If the system were working the way Democrats suggested it was, then would-be double voters would be denied at the polls.

That is not what happened in Georgia, however, appearing to lend credence to Republicans’ claims.

Anything else?

Raffensperger made clear in his comments that the double voting did not change any race outcomes in the primary election.

Nevertheless, he said that the Georgia attorney general’s office along with local prosecutors will look to punish the offenders for their offense. Double voting in Georgia is a felony punishable by up to 10 years in prison and up to $100,000 in fines.

In response to the announcement, Democratic Party of Georgia executive director Scott Hogan insisted that fraud is rare in Georgia elections and accused Raffensperger of pushing “conspiracy theories.”

“It is clear that rather than do his job of promoting the safety and security of our voting process, the secretary of state is instead pushing the GOP’s voting conspiracy theories and disinformation,” he said.

Why We Are Facing The Biggest Election Nightmare In Modern American History No Matter Who Ends Up Winning

It looks like we are headed for the most chaotic presidential election in modern U.S. history.  According to some estimates, somewhere around 40 percent of all U.S. voters will vote by mail this year.  That means that tens of millions of votes will be going through the postal system, and that has the potential to create all sorts of problems.  For one thing, it is going to take a lot of extra time to open those ballots and count them.  For states that allow mail-in votes to be counted in advance, that shouldn’t delay final results by too much, but in other states we are facing the possibility of a nightmare scenario.  There are certain states that are not allowed to start counting any ballots until the polls close on election day, and that includes key swing states such as Wisconsin, Michigan and Pennsylvania

In several states not accustomed to high volumes of mail-in voting, including Rust Belt swing states Wisconsin, Michigan and Pennsylvania, election officials cannot start counting ballots until voting ends on election night. Other swing states, such as Minnesota, allow absentee ballots to be postmarked up to Election Day.

So as we all watch the election results come in on the night of November 3rd, what we will be getting will only be partial results.

And at this point the mainstream media is assuming that the votes that are cast in person will heavily favor President Trump, and so they are warning us that there could be a “red mirage” scenario in which it appears that Trump is easily winning an election that he has actually lost.

Of course if Trump builds a huge lead on election night, he is likely to declare victory, and Facebook has already stated that they intend to “flag” any such attempt…

Facebook plans to flag any attempt by the Trump campaign to declare a premature victory in the presidential race on the platform, the company announced on Thursday.

The social media giant, which has come in for heavy criticism for failing to police foreign and domestic elections propaganda on its network, also said it would not accept any new political ads in the final week of the 2020 presidential race.

This is one of the reasons why I have always been strongly against mail-in voting.  Our nation is likely to be thrown into a state of chaos in November because it is going to take so long to count all the votes.  President Trump and his supporters will be absolutely convinced that they have won the election if they have a big lead on election night, and Joe Biden and his supporters will be absolutely convinced that they will be victorious once all of the mail-in votes are finally counted.  And then no matter what the final result is, about half the country will not be willing to accept it as legitimate.

This is going to be such a disaster, but nobody can do anything about it now.  All we can do is watch this slow-motion train wreck play out.

Biden supporters are already pointing to a recent poll which shows that Biden voters are far more likely to vote by mail than Trump supporters are…

Forty-seven percent of voters who plan to vote for Biden say they are likely to vote by mail, according to a USA TODAY/Suffolk University poll released Wednesday. That’s more than double the 21% of voters backing Trump who say they are likely to vote by mail. The poll found 56% of Republicans say they intend to vote on Election Day, compared with 26% of Democrats.

If all of the votes were counted and released at one time, this wouldn’t be so much of a problem.

But instead most of the results that we will get on election night will be from in-person voting, and most of the mail-in votes will be counted some time later.

At this point, everyone should be able to see that this is almost certainly not going to end well.

So many Trump voters prefer to vote the old-fashioned way, while many Democrats are very eager to vote by mail, and this has created a huge disparity in ballot requests in some of the most critical swing states.  Just check out these numbers

In Pennsylvania – a state Trump won in 2016 but where polling shows him behind – nearly 900,000 Democrats have requested a mail ballot for the election, more than twice the 347,000 Republicans who have done so. In North Carolina, another state Trump won in 2016 but where he and Biden are in a close race, nearly 313,000 Democrats requested mail ballots compared with nearly 93,000 Republicans.

We are seeing similar numbers in other states, and this is one of the reasons why Joe Biden will not concede no matter how large Trump’s lead on election night is.

This thing could end up dragging out for an extended period of time, and that is extremely unfortunate.

And the truth is that we may never even know the true winner of the 2020 election.  Voting by mail opens up so many opportunities for fraud, and large numbers of ballots never even get delivered to the intended voters in the first place.  As Breitbart has reported, 17 percent of the ballots that were sent out to registered voters in Nevada for their primary in June came back as “undeliverable”…

Last month, the Trump campaign filed suit against Nevada for their universal mail-in voting plans that would allow votes submitted after election day to count for the election. More than 223,000 mail-in ballots sent to registered voters in Las Vegas, Nevada, for their June primary bounced as “undeliverable” — 17 percent of the total 1,325,934 mail-in ballots that were sent out in the county.

Over the next couple of months, tens of millions of ballots are going to be floating around out there, and many will end up in the hands of people that should not have them.  For example, Hulk Hogan says that one of his friends just received a ballot that was addressed to his dog

Crazy stuff, a friend of mine just got a mail in ballot for his dog Nugget? Now even dogs can vote!

How does something like that happen?

Another thing to watch out for is “ballot harvesting”.  Democrats have become masters of this practice, and they used it with devastating effectiveness in California in 2018.  Now they are deploying this tactic all over the nation, and very alarming incidents of abuse are already being reported

Furthermore, a citizen journalist reported that Democrats were harvesting mail-in ballots from nursing homes in Texas by fraudulently submitting ballot applications in bulk.

The journalist said that at least 32 applications supposedly from elderly voters were all submitted with the exact same handwriting, and were all submitted using the same pre-printed envelope with the same-style stamp.

In the end, we should all want a legitimate outcome.  The integrity of our elections is of paramount importance, and the will of the American people should be respected.

But I don’t think that any of us will ever be able to feel good about the outcome of this election no matter who ends up winning.

Needless to say, the losing side is likely to be absolutely enraged over an election that they feel has been stolen from them, and that is likely to make the current chaos in our streets even worse.

At this point, even the Washington Post is warning that this election is likely to end “catastrophically”…

Perspective: The election will likely spark violence — and a constitutional crisis.

In every scenario except a Biden landslide, our simulation ended catastrophically.

For once, I actually agree with the Washington Post.

I have a hard time trying to imagine how this election could possibly end well.

Right now, Trump and his supporters are convinced that Trump will win, and Biden and his supporters are convinced that Biden will win.

One side is going to be bitterly, bitterly disappointed, and they will almost certainly feel like the election was not won legitimately.

There is going to be so much anger, and when it explodes it is going to be very frightening to watch.

This is already such a dark chapter in American history, and this election is going to take things to an entirely new level.

Sadly, I believe that after November 2020 nothing in this country will ever be the same again.

Trump encourages NC voters to test voting system by mailing in votes and trying to vote in person. White House says he is not advocating doing ‘anything unlawful.’

President Donald Trump encouraged North Carolina voters to test the voting system during the 2020 presidential election. He advocated that voters send in their mail-in ballots early, but to also attempt to vote in-person to see if the mail-in ballot had been tabulated.

Critics said Trump instructed voters to vote twice, which is illegal, but the White House refuted the idea that the president was telling supporters to do “anything unlawful.”

President Trump visited North Carolina on Wednesday to deliver a speech at the Battleship North Carolina to commemorate the 75th anniversary of the end of World War II. Upon arriving at the Wilmington International Airport, Trump addressed a crowd that gathered to welcome the president. He suggested that voters test the integrity of the voting system.

“If you get the unsolicited ballots, send it in, and then go — make sure it counted,” Trump told his supporters. “And if it doesn’t tabulate, you vote. You just vote. And then if they tabulate it very late, which they shouldn’t be doing, they’ll see you voted, and so it won’t count. So, send it in early, and then go and vote. And if it’s not tabulated — you vote. And the vote is going to count.”

President Trump doubled down on his notion of testing the integrity of the system by voting via mail-in ballot, but also attempt to vote in-person if the mail-in vote was not tallied.

“They’ll go out and they’ll vote and they’re going to have to go and check their vote by going to the poll and voting that way because if it tabulates then they won’t be able to do that,” Trump said in an interview with WCET-TV. “So, let them send it in and let them go vote and if their system’s as good as they say it is, then obviously they won’t be able to vote. If it isn’t tabulated they’ll be able to vote so that’s the way it is.”

“I don’t like the idea of these unsolicited votes. I never did. It leads to a lot of problems,” Trump added. “They’ve got 11 problems already on very small contests. I’m not happy about it. At the same time, we’re in court with a lot of it. We’re going to see if it can be stopped.

“But send in your ballots, send them in strong, whether it’s solicited or unsolicited,” the president concluded. “The absentees are fine, we have to work to get them; you know it means something. And you send them in, but you go to vote. And if they haven’t counted it, you can vote. That’s the way I view it.”

52 U.S. Code § 10307 prohibits voting more than once, unless “all prior ballots of that voter were invalidated.”

Whoever votes more than once in an election referred to in paragraph (2) shall be fined not more than $10,000 or imprisoned not more than five years, or both. The prohibition of this subsection applies with respect to any general, special, or primary election held solely or in part for the purpose of selecting or electing any candidate for the office of President, Vice President, presidential elector, Member of the United States Senate, Member of the United States House of Representatives, Delegate from the District of Columbia, Guam, or the Virgin Islands, or Resident Commissioner of the Commonwealth of Puerto Rico. As used in this subsection, the term ‘votes more than once’ does not include the casting of an additional ballot if all prior ballots of that voter were invalidated, nor does it include the voting in two jurisdictions under section 10502 of this title, to the extent two ballots are not cast for an election to the same candidacy or office.

North Carolina Board of Elections Executive Director Karen Brinson Bell issued a letter about voting more than once.

“It is illegal to vote twice in an election. N.C.G.S. § 163-275(7) makes it a Class I felony for a voter, ‘with intent to commit a fraud to register or vote at more than one precinct or more than one time…in the same primary or election,'” the letter read. “Attempting to vote twice in an election or soliciting someone to do so also is a violation of North Carolina law.”

“There are numerous checks in place in North Carolina that prevent people from double voting,” Bell wrote. “Electronic pollbooks with information about who has already voted are used at every early voting site. If a voter tries to check in who has already voted, they will be prevented from voting a regular ballot. A voter will be offered a provisional ballot if they insist on voting, and this ballot will be researched after Election Day to determine whether it should be counted.”

The North Carolina State Board of Elections website states, “If someone has voted an absentee ballot and then shows up to vote in person, the check-in system will alert the poll worker that the person has already voted.”

United States Attorney General William Barr was asked about Trump’s comments by CNN’s Wolf Blitzer on Wednesday afternoon.

“Well, I don’t know exactly what he was saying,” Barr said of Trump’s remarks. “But it seems to me what he’s saying is he’s trying to make the point that the ability to monitor this system is not good and if it was so good, if you tried to vote a second time, you would be caught if you voted in-person.”

Then Barr vigorously condemned anyone advocating for mail-in voting and said lawmakers are “playing with fire” because of the threat of widespread fraud.

“This is playing with fire. We’re a very closely divided country here. And people have to have confidence in the results of the election and the legitimacy of the government, and people trying to change the rules to this to this methodology which, as a matter of logic is very open to fraud and coercion, is reckless and dangerous and people are playing with fire,” Barr said on CNN’s “The Situation Room with Wolf Blitzer.”

“The only time the narrative changed is after this administration came in. But elections that have been held with mail have found substantial fraud and coercion,” Barr explained. “For example, we indicted someone in Texas — 1,700 ballots collected from people who could vote — he made them out and voted for the person he wanted to, OK, because, that kind of thing happens with mail-in ballots.”

Blitzer claimed that there is no evidence of widespread mail-in voting fraud.

“We haven’t had the kind of widespread use of mailing ballots as being proposed,” Barr replied. “We’ve had absentee ballots from people who request them from a specific address. Now what we’re talking about is mailing them to everyone on the voter list when everyone knows those voter lists are inaccurate.”

On the topic of media coverage, the attorney general told Blitzer, “The media should be fair and balanced no matter who the president is. [It] doesn’t give the media license to lie the way a lot of the media is.”

“I can speak for us, we are fair and balanced,” Blitzer said of CNN.

Barr responded with a chuckle and said, “OK.”

White House press secretary Kayleigh McEnany said that President Trump was not advocating that people “do anything unlawful” when it comes to voting.

“The president is not suggesting anyone do anything unlawful. What he said very clearly there is make sure your vote is tabulated and if it is not, then vote,” McEnany said Thursday in an interview on Fox News.

“Basically, when you get an absentee ballot and you send it in, there are poll books and it is recorded that you have in fact voted,” McEnany added. “And if you show up at a polling site, they look at the poll book and say your vote has been counted. He wants verification.”

New Narrative Being Pushed: Trump Will Lead Big On Election Night, But Biden Will Eventually Win Because Of Mail-In Ballots

We are not going to know the winner of the presidential election on the night of November 3rd.  Sadly, we almost certainly won’t know the winner the next day either.  In fact, it may be many weeks before a winner is formally declared.  Laws have been passed all over the country to make voting by mail much easier, and it is being very heavily promoted in many states.  It is being projected that at least 83 percent of all U.S. voters will be eligible to vote by mail in November, and that is an astounding number.  If all of those people actually did vote by mail, more than 190 million votes would go through our postal system.  But of course many people will continue to show up in person and vote the old-fashioned way.  We will get the results from those that vote in person on election day very rapidly like we normally do, but it may take a very long time before all of the mail-in votes are tallied.  As I will explain in this article, this has the potential to create some enormous problems.

It is being generally assumed by the political “experts” that Trump will do very well among those that show up in person to vote and that Biden will do very well among those that vote by mail.

If that assumption is true, some Democrats are warning that it could look like Trump will win the election based on the results that we are given on the night of November 3rd, but once all of the mail-in votes are counted Biden will actually be the true winner.

Specifically, this is a narrative that Democratic pollster Josh Mendelsohn is now pushing heavily.  According to a “scenario” modeled by his firm, the results on election night could show Trump winning 408 electoral votes

“We are sounding an alarm and saying that this is a very real possibility, that the data is going to show on election night an incredible victory for Donald Trump,” HawkFish CEO Josh Mendelsohn said in an interview with Axios on HBO.

One scenario modeled by Mendelsohn’s polling firm even shows Trump prevailing in the Electoral College on election night, winning 408 electoral votes compared to just 130 for Democratic presidential nominee Joe Biden.

Could you imagine the euphoria of Trump supporters if this is what the numbers actually show on the night of November 3rd?

Everyone would be talking about a “Trump landslide” and there would be wild dancing in the streets in many red states.

But Mendelsohn is anticipating that only about 15 percent of all mail-in votes will be counted by election night, and he believes that once all of the mail-in votes are counted that Biden will be declared the true winner

That scenario accounts for the idea that just 15 percent of mail-in votes will be counted by election night. In that event, the model suggests, Biden could prevail days later — if counting goes smoothly — by 334 electoral votes to 204 for Trump.

“When every legitimate vote is tallied and we get to that final day, which will be some day after Election Day, it will in fact show that what happened on election night was exactly that, a mirage,” Mendelsohn said.

I don’t even want to imagine the uproar that would be created if such a scenario actually played out.

Even if there was no vote fraud, and even if every single vote was counted accurately, tens of millions of people would still be absolutely convinced that the election was stolen from Trump.

And even Mendelsohn is admitting that the outcome he is projecting would “shake the losing side’s faith in the integrity of the election”.

Personally, I think that mail-in voting is such a bad idea no matter which party it favors.  It opens up so many opportunities for potential vote fraud, and the delay in getting the results is very bad for our nation.

I believe that we will see some precincts in some swing states with a voter participation rate of more than 100 percent this year.  In other words, I believe that in some precincts the number of votes cast will actually outnumber the true number of actual voters.

Let’s keep a close eye on the results as they come in throughout the month of November and see if I am actually correct.  In my opinion there is going to be quite a bit of monkey business going on with mail-in ballots, and President Trump has been greatly concerned about mail-in ballots as well.  In fact, on Wednesday he once again expressed his concern that the upcoming election could be rigged

Wednesday: Trump retweeted an article from a conservative publication that raised questions about the impact of mail-in voting on the upcoming election and added his own editorial comment. “Rigged election?” he asked.

I have always believed that voters should be required to vote in person as much as possible and that paper ballots should always be used.  Those two measures alone would certainly not completely fix our system, but they would definitely go a long way toward restoring integrity to the voting process.

As it stands now, we are heading into a nightmare election.  We all know that it is exceedingly unlikely that Trump will concede on election night, and Hillary Clinton continues to insist that Joe Biden should not concede under any circumstances

In a rare joint interview with American Urban Radio Washington Bureau Chief April Ryan, Hillary Clinton added to her demands that Democrat Joe Biden not concede on election night, and Bill Clinton suggested that Trump will reinforce the White House to keep officials from pulling him out on Inauguration Day.

“Do not concede under any circumstance because I believe the other side is going to cheat and sneak and try everything they possibly can,” said Hillary Clinton in the “#COVID Conversations” interview broadcast via Instagram.

So we are probably going to have to wait for weeks before every vote is finally counted.

And then if it is still very close, there will probably be legal challenges which will have to work their way through the courts.

If things are tight enough, we may not have a formal winner until some time in 2021.

No matter who ends up being victorious, I believe that the election of 2020 is going to be a nightmare for America.  It is likely that we will see vote fraud on a scale that we have never seen before, millions of those on the losing side will probably never accept the final result as legitimate, and the chaos caused by a contested outcome could result in even more violence in our streets.

We will see what happens, but right now I have a very, very bad feeling about what is going to happen in November.
