Proctoring Tools and Dragnet Investigations Rob Students of Due Process

Like many schools, Dartmouth College has increasingly turned to technology to monitor students taking exams at home. And while many universities have used proctoring tools that purport to help educators prevent cheating, Dartmouth’s Geisel School of Medicine has gone dangerously further. Apparently working under an assumption of guilt, the university is in the midst of a dragnet investigation of complicated system logs, searching for data that might reveal student misconduct, without a clear understanding of how those logs can be littered with false positives. Worse still, those attempting to assert their rights have been met with a university administration more willing to trust opaque investigations of inconclusive data sets rather than their own students.

The Boston Globe explains that the medical school administration’s attempts to detect supposed cheating have become a flashpoint on campus, exemplifying a worrying trend of schools prioritizing misleading data over the word of their students. The misguided dragnet investigation has cast a shadow over the career aspirations of over twenty medical students.

What’s Wrong With Dartmouth’s Investigation

In March, Dartmouth’s Committee on Student Performance and Conduct (CSPC) accused several students of accessing restricted materials online during exams. These accusations were based on a flawed review of an entire year’s worth of the students’ log data from Canvas, the online learning platform that contains class lectures and information. This broad search was instigated by a single incident of confirmed misconduct, according to a contentious town hall between administrators and students (we’ve re-uploaded this town hall, as it is now behind a Dartmouth login screen). These logs show traffic between students’ devices and specific files on Canvas, some of which contain class materials, such as lecture slides. At first glance, the logs showing that a student’s device connected to class files would appear incriminating: timestamps indicate the files were retrieved while students were taking exams. 

But after reviewing the logs that were sent to EFF by a student advocate, it is clear to us that there is no way to determine whether this traffic happened intentionally, or instead automatically, as background requests from student devices, such as cell phones, that were logged into Canvas but not in use. In other words, rather than the files being deliberately accessed during exams, the logs could have easily been generated by the automated syncing of course material to devices logged into Canvas but not used during an exam. It’s simply impossible to know from the logs alone if a student intentionally accessed any of the files, or if the pings exist due to automatic refresh processes that are commonplace in most websites and online services. Most of us don’t log out of every app, service, or webpage on our smartphones when we’re not using them.

Much like a cell phone pinging a tower, the logs show files being pinged in short time periods and sometimes being accessed at the exact second that students are also entering information into the exam, suggesting a non-deliberate process. The logs also reveal that the files accessed are largely irrelevant to the tests in question, also indicating  an automated, random process. A UCLA statistician wrote a letter explaining that even an automated process can result in multiple false-positive outcomes. Canvas’ own documentation explicitly states that the data in these logs “is meant to be used for rollups and analysis in the aggregate, not in isolation for auditing or other high-stakes analysis involving examining single users or small samples.” Given the technical realities of how these background refreshes take place, the log data alone should be nowhere near sufficient to convict a student of academic dishonesty. 

Along with The Foundation for Individual Rights in Education (FIRE), EFF sent a letter to the Dean of the Medical School on March 30th, explaining how these background connections work and pointing out that the university has likely turned random correlations into accusations of misconduct. The Dean’s reply was that the cases are being reviewed fairly. We disagree.

It appears that the administration is the victim of confirmation bias, turning fallacious evidence of misconduct into accusations of cheating. The school has admitted in some cases that the log data appeared to have been created automatically, acquitting some students who pushed back. But other students have been sanctioned, apparently entirely based on this spurious interpretation of the log data. Many others are anxiously waiting to hear whether they will be convicted so they can begin the appeal process, potentially with legal counsel. 

These convictions carry heavy weight, leaving permanent marks on student transcripts that could make it harder for them to enter residencies and complete their medical training. At this level of education, this is not just about being accused of cheating on a specific exam. Being convicted of academic dishonesty could derail an entire career. 

University Stifles Speech After Students Express Concerns Online

Worse still, following posts from an anonymous Instagram account apparently run by students concerned about the cheating accusations and how they were being handled, the Office of  Student Affairs introduced a new social media policy.

An anonymous Instagram account detailed some concerns students have with how these cheating allegations were being handled (accessed April 7). As of April 15, the account was offline.

The policy was emailed to students on April 7 but backdated to April 5—the day the Instagram posts appeared. The new policy states that, “Disparaging other members of the Geisel UME community will trigger disciplinary review.” It also prohibits social media speech that is not “courteous, respectful, and considerate of others” or speech that is “inappropriate.” Finally, the policy warns, “Students who do not follow these expectations may face disciplinary actions including dismissal from the School of Medicine.” 

One might wonder whether such a policy is legal. Unfortunately, Dartmouth is a private institution and so not prohibited by the First Amendment from regulating student speech.

If it were a public university with a narrower ability to regulate student speech, the school would be stepping outside the bounds of its authority if it enforced the social media policy against medical school students speaking out about the cheating scandal. On the one hand, courts have upheld the regulation of speech by students in professional programs at public universities under codes of ethics and other established guidance on professional conduct. For example, in a case about a mortuary student’s posts on Facebook, the Minnesota Supreme Court held that a university may regulate students’ social media speech if the rules are “narrowly tailored and directly related to established professional conduct standards.” Similarly, in a case about a nursing student’s posts on Facebook, the Eleventh Circuit held that “professional school[s] have discretion to require compliance with recognized standards of the profession, both on and off campus, so long as their actions are reasonably related to legitimate pedagogical concerns.” On the other hand, the Sixth Circuit has held that a university can’t invoke a professional code of ethics to discipline a student when doing so is clearly a “pretext” for punishing the student for her constitutionally protected speech.

Although the Dartmouth medical school is immune from a claim that its social media policy violates the First Amendment, it seems that the policy might unfortunately be a pretext to punish students for legitimate speech. Although the policy states that the school is concerned about social media posts that are “lapses in the standards of professionalism,” the timing of the policy suggests that the administrators are sending a message to students who dare speak out against the school’s dubious allegations of cheating. This will surely have a chilling effect on the community to the extent that students will refrain from expressing their opinions about events that occur on campus and affect their future careers. The Instagram account was later taken down, indicating that the chilling effect on speech may have already occurred. (Several days later, a person not affiliated with Dartmouth, and therefore protected from reprisal, has reposted many of the original Instagram’s posts.)

Students are at the mercy of private universities when it comes to whether their freedom of speech will be respected. Students select private schools based on their academic reputation and history, and don’t necessarily think about a school’s speech policies. Private schools shouldn’t take advantage of this, and should instead seek to sincerely uphold free speech principles.

Investigations of Students Must Start With Concrete Evidence

Though this investigation wasn’t the result of proctoring software, it is part and parcel of a larger problem: educators using the pandemic as an excuse to comb for evidence of cheating in places that are far outside their technical expertise. Proctoring tools and investigations like this one flag students based on flawed metrics and misunderstandings of technical processes, rather than concrete evidence of misconduct. 

Simply put: these logs should not be used as the sole evidence for potentially ruining a student’s career. 

Proctoring software that assumes all students take tests the same way—for example, in rooms that they can control, their eyes straight ahead, fingers typing at a routine pace—puts a black mark on the record of students who operate outside the norm. One problem that has been widely documented with proctoring software is that students with disabilities (especially those with motor impairment) are consistently flagged as exhibiting suspicious behavior by software suites intended to detect cheating. Other proctoring software has flagged students for technical snafus such as device crashes and Internet cuts out, as well as completely normal behavior that could indicate misconduct if you squint hard enough.

For the last year, we’ve seen far too many schools ignore legitimate student concerns about inadequate, or overbroad, anti-cheating software. Across the country, thousands of students, and some parents, have created petitions against the use of proctoring tools, most of which (though not all) have been ignored. Students taking the California and New York bar exams—as well as several advocacy organizations and a group of deans—advocated against the use of proctoring tools for those exams. As expected, many of those students then experienced “significant software problems” with the Examsoft proctoring software, specifically, causing some students to fail. 

Many proctoring companies have defended their dangerous, inequitable, privacy-invasive, and often flawed software tools by pointing out that humans—meaning teachers or administrators—usually have the ability to review flagged exams to determine whether or not a student was actually cheating. That defense rings hollow when those reviewing the results don’t have the technical expertise—or in some cases, the time or inclination—to properly examine them.

Similar to schools that rely heavily on flawed proctoring software, Dartmouth medical school has cast suspicion on students by relying on access logs that are far from concrete evidence of cheating. Simply put: these logs should not be used as the sole evidence for potentially ruining a student’s career. 

The Dartmouth faculty has stated that they will not continue to look at Canvas logs in the future for violations (51:45 into the video of the town hall). That’s a good step forward. We insist that the school also look beyond these logs for the students currently being investigated, and end this dragnet investigation entirely, unless additional evidence is presented.

NASA approved to test new technology that will PUNCH an asteroid headed toward Earth

It would be impressive if technology existed that could deflect an asteroid on a path toward Earth and save mankind from devastating impact. Well, NASA plans to test new technology that aims to do just that.

On Wednesday’s show, Pat Gray and Jeff Fisher detailed how NASA has approved a project called the Double Asteroid Redirection Test, the aim of which is to throw a “small” asteroid off course in October 2022.

Pat called the technology amazing and later added that it would be impressive if we have the capability to move an asteroid out of its flight path. Watch the clip for more from Pat.

553,000,000 Reasons Not to Let Facebook Make Decisions About Your Privacy

Another day, another horrific Facebook privacy scandal. We know what comes next: Facebook will argue that losing a lot of our data means bad third-party actors are the real problem that we should trust Facebook to make more decisions about our data to protect against them. If history is any indication, that’ll work. But if we finally wise up, we’ll respond to this latest crisis with serious action: passing America’s long-overdue federal privacy law (with a private right of action) and forcing interoperability on Facebook so that its user/hostages can escape its walled garden.

Facebook created this problem, but that doesn’t make the company qualified to fix it, nor does it mean we should trust them to do so. 

In January 2021, Motherboard reported on a bot that was selling records from a 500 million-plus person trove of Facebook  data, offering phone numbers and other personal information. Facebook said the data had been scraped by using a bug that was available as early as 2016, and which the company claimed to have patched in 2019. Last week, a dataset containing 553 million Facebook users’ data—including phone numbers, full names, locations, email addresses, and biographical informationwas published for free online. (It appears this is the same dataset Motherboard reported on in January). More than half a billion current and former Facebook users are now at high risk of various kinds of fraud.

While this breach is especially ghastly, it’s also just another scandal for Facebook, a company that spent decades pursuing deceptive and anticompetitive tactics to amass largely nonconsensual dossiers on its 2.6 billion users as well as many billions of people who have no Facebook, Instagram or WhatsApp account, including many who never had an account with Facebook.

Based on past experience, Facebook’s next move is all but inevitable: after regretting this irretrievable data breach, the company will double down on the tactics that lock its users into its walled gardens, in the name of defending their privacy. That’s exactly what the company did during the Cambridge Analytica fiasco, when it used the pretense of protecting users from dangerous third-parties to lock out competitors, including those who use Facebook’s APIs to help users part ways with the service without losing touch with their friends, families, communities, and professional networks.

According to Facebook, the data in this half-billion-person breach was harvested thanks to a bug in its code. We get that. Bugs happen. That’s why we’re totally unapologetic about defending the rights of security researchers and other bug-hunters who help discover and fix those bugs. The problem isn’t that a Facebook programmer made a mistake: the problem is that this mistake was so consequential.

Facebook doesn’t need all this data to offer its users a social networking experience: it needs that data so it can market itself to advertisers, who paid the company $84.1 billion in 2020. It warehoused that data for its own benefit, in full knowledge that bugs happen, and that a bug could expose all of that data, permanently. 

Given all that, why do users stay on Facebook? For many, it’s a hostage situation: their friends, families, communities, and professional networks are on Facebook, so that’s where they have to be. Meanwhile, those friends, family members, communities, and professional networks are stuck on Facebook because their friends are there, too. Deleting Facebook comes at a very high cost.

It doesn’t have to be this way. Historically, new online services—including, at one time, Facebook—have smashed big companies’ walled gardens, allowing those former user-hostages to escape from dominant services but still exchange messages with the communities they left behind, using techniques like scraping, bots, and other honorable tools of reverse-engineering freedom fighters. 

Facebook has gone to extreme lengths to keep this from ever happening to its services. Not only has it sued rivals who gave its users the ability to communicate with their Facebook friends without subjecting themselves to Facebook’s surveillance, the company also bought out successful upstart rivals specifically because it knew it was losing users to them. It’s a winning combination: use the law to prevent rivals from giving users more control over their privacy, use the monopoly rents those locked-in users generate to buy out anyone who tries to compete with you.

Those 553,000,000 users whose lives are now an eternal open book to the whole internet never had a chance. Facebook took them hostage. It harvested their data. It bought out the services they preferred over Facebook. 

And now that 553,000,000 people should be very, very angry at Facebook, we need to watch carefully to make sure that the company doesn’t capitalize on their anger by further increasing its advantage. As governments from the EU to the U.S. to the UK consider proposals to force Facebook to open up to rivals so that users can leave Facebook without shattering their social connections, Facebook will doubtless argue that such a move will make it impossible for Facebook to prevent the next breach of this type.

Facebook is also likely to weaponize this breach in its ongoing war against accountability: namely, against a scrappy group of academics and Facebook users. Ad Observer and Ad Observatory are a pair of projects from NYU’s Online Transparency Project that scrape the ads its volunteers are served by Facebook and places them in a public repository, where scholars, researchers, and journalists can track how badly Facebook is living up to its promise to halt paid political disinformation.

Facebook argues that any scraping—even highly targeted, careful, publicly auditable scraping that holds the company to account—is an invitation to indiscriminate mass-scraping of the sort that compromised the half-billion-plus users in the current breach. Instead of scraping its ads, the company says that its critics should rely on a repository that Facebook itself provides, and trust that the company will voluntarily reveal any breaches of its own policies.

From Facebook’s point of view, a half-billion person breach is a half-billion excuses not to open its walled garden or permit accountability research into its policies. In fact, the worse the breach, the more latitude Facebook will argue it should get: “If this is what happens when we’re not being forced to allow competitors and critics to interoperate with our system, imagine what will happen if these digital trustbusters get their way!”

Don’t be fooled. Privacy does not come from monopoly. No one came down off a mountain with two stone tablets, intoning “Thou must gather and retain as much user data as is technologically feasible!” The decision to gobble up all this data and keep it around forever has very little to do with making Facebook a nice place to chat with your friends and everything to do with maximizing the company’s profits. 

Facebook’s data breach problems  are the inevitable result of monopoly, in particular the knowledge that it can heap endless abuses on its users and retain them. Even if they resign from Facebook, they’re going to end up on acquired Facebook subsidiaries like Instagram or WhatsApp, and even if they don’t, Facebook will still get to maintain its dossiers on their digital lives.

Facebook’s breaches are proof that we shouldn’t trust Facebook—not that we should trust it more. Creating a problem in no way qualifies you to solve that problem. As we argued in our January white-paper, Privacy Without Monopoly: Data Protection and Interoperability, the right way to protect users is with a federal privacy law with a private right of action.

Right now, Facebook’s users have to rely on Facebook to safeguard their interests. That doesn’t just mean crossing their fingers and hoping Facebook won’t make another half-billion-user blunder—it also means hoping that Facebook won’t intentionally disclose their information to a third party as part of its normal advertising activities. 

Facebook is not qualified to decide what the limits on its own data-processing should be. Those limits should come from democratically accountable legislatures, not autocratic billionaire CEOs. America is sorely lacking a federal privacy law, particularly one that empowers internet users to sue companies that violate their privacy. A privacy law with a private right of action would mean that you wouldn’t be hostage to the self-interested privacy decisions of vast corporations, and it would mean that when they did you dirty, you could get justice on your own, without having to convince a District Attorney or Attorney General to go to bat for you.

A federal privacy law with a private right of action would open a vast possible universe of new interoperable services that plugged into companies like Facebook, allowing users to leave without cancelling their lives; these new services would have to play by the federal privacy rules, too.

That’s not what we’re going to hear from Facebook, though: in Facebookland, the answer to their abuse of our trust is to give them more of our trust; the answer to the existential crisis of their massive scale is to make them even bigger. Facebook created this problem, and they are absolutely incapable of solving it.

Yes, America Is On The Verge Of Yet Another Toilet Paper Crisis

It is starting to happen again.  Do you remember how “panic buying” caused a massive shortage of toilet paper and other basic essentials during the early days of the COVID pandemic last year?  Well, shortages are back, but this time around different factors are at play.  We are being told that the shortages should just be temporary, and that is good news.  But this is yet another example that shows how exceedingly vulnerable global supply chains have become in this day and age.  If another major global crisis were to suddenly strike, we could quickly be facing long-term shortages of certain items that would be quite severe.  So hopefully this short-term toilet paper shortage will be a wake up call for all of us.  The following comes from Yahoo News

Who can forget last year’s empty store shelves and pandemic panic shopping, right? Cleaning products, hand sanitizer and toilet paper were all but impossible to find, and only recently have name-brand disinfectant wipes and sprays begun showing up in stores again,

Well, brace yourself, because another product shortage is looming — and yes, it may very well become tough to find toilet paper again.

This new toilet paper shortage is not being caused by “panic buying”.  Instead, two factors have combined to create serious delays in getting products from overseas…

For six days, Egypt’s Suez Canal was blocked by a giant cargo vessel that got stuck and held up hundreds of other ships on a route that handles about 12% of world trade. The Ever Given — about as long as the Empire State Building is tall — was finally freed Monday, but analysts say it could take more than a week to clear the backup.

Meanwhile, a shortage of shipping containers also is causing problems in the cargo transport industry. Many of the factories that build the giant metal boxes are in China — and a number of them shut down in the early days of the COVID crisis, cutting supplies short.

Needless to say, it won’t just be toilet paper that is affected.

Even now, you are probably noticing empty shelves at some of your favorite retail outlets, and that will probably continue to be the case for quite some time.

Meanwhile, prices on many of our favorite consumer products are going to be rising substantially.  For example, even though we are being told that the current toilet paper shortages will just be “temporary”, the price increases that are coming will not be

The maker of the Cottonelle, Scott and Viva brands announced Wednesday that it will hike prices on “a majority of its North America consumer products business,” including toilet paper and baby care items.

Kimberly-Clark Corporation blamed rising commodity costs for the increases.

In response to the COVID pandemic, governments all over the globe have been creating, borrowing and spending money like there is no tomorrow.

As a result, commodity prices have shot through the roof, and companies are starting to pass those price increases along to consumers.

Our politicians always seem to think that “more money” is the solution, but their reckless policies are starting to cause some very serious long-term problems.  Here in the United States, we have now seen the money supply grow at an insane pace for 11 months in a row

In February, money supply growth hit yet another all-time high. February’s surge in money-supply growth makes February the eleventh month in a row of remarkably high growth, and came in the wake of unprecedented quantitative easing, central bank asset purchases, and various stimulus packages.

During February 2021, year-over-year (YOY) growth in the money supply was at 39.1 percent. That’s up slightly from January’s rate of 38.7 percent, and up from the February 2020 rate of 7.3 percent. Historically this is a very large surge in growth, year over year. It is also quite a reversal from the trend that only just ended in August of 2019 when growth rates were nearly bottoming out around 2 percent.

We are on a hyperinflationary path, and everyone knows that this story is not going to end well.

One area where we are already seeing tremendous inflation is in home prices

House prices rose by 11.2% from a year ago, the biggest increase since the peak of Housing Bubble 1 in 2006, according to today’s National Case-Shiller Home Price Index for January.

The index is a good measure of “house-price inflation” because it’s based on the “sales pairs” method, comparing the sales price of a house in the current month to the price of the same house when it sold previously, thereby tracking the amount of dollars it takes to buy the same house over time.

But that number doesn’t tell the entire story.

Home prices are actually going down in some core urban areas, and they are escalating dramatically in desirable rural and suburban communities around the nation.  This is something that I discussed in my previous article entitled “We Have Never Seen A Home Buying Frenzy Quite Like This”.

Those at the very top of the economic pyramid are gobbling up homes at a feverish pace, but meanwhile an increasing number of Americans are no longer able to afford homes at all.  Homelessness and poverty are absolutely exploding all over the country, and things are particularly bad on the west coast.

In Seattle, tents have taken over sidewalks and parks all over the city.  If you drive through the heart of Seattle, you will literally see homeless encampments everywhere that you go

Fox News analyst Lawrence Jones spoke with Seattle residents about the homeless crisis and encampments taking over their neighborhood parks.

When asked how the presence of homeless tents and encampments in her neighborhood made her feel, one Seattle resident told Jones that it made her feel “sad” and “depressed.”

In one residential area of Seattle, tents filled parks and sports fields where young children would typically play.

I would like to tell you that this homelessness crisis is just temporary, but I can’t.

Unfortunately, the truth is that economic conditions in America will eventually get a whole lot worse.

The short-term toilet paper shortages that we are facing now are an inconvenience, but the truth is that they aren’t even worth comparing to the problems that we will be facing down the road.

So stock up and get prepared while you still can, because things aren’t going to be getting any easier as we roll into a very uncertain future.

Crowdfunding Legal Fees Is Not a Crime

A piece in USA Today describes how a number of Capitol Hill rioters are utilizing online fundraising platforms to raise funds to cover legal fees, only to find their accounts shut down. This is prompting an online discussion not only about when and how tech companies should shutter online accounts for those accused of illegal activity but also about what financial services should be available to those accused of a crime.

The piece seemingly conflates the crowdfunding of legal fees with “crowdfunding hate,” an argument that needs some unpacking.

The justification for banning right-wing extremists from using online platforms to raise funds for a legal defense is made from a concern that such donations will be used for activities that promote hate, violence, or racial intolerance. And yet, the determination of what constitutes such activities is meant to be left to online platforms and service providers. That is, the behavior that people are demanding that these companies regulate is not, in most cases, illegal. Without guidance from the law, the companies are left to make subjective decisions about who should be allowed to use their services—decisions that are increasingly informed by public pressure.

There is a long history of corporations denying services to a wide range of actors, and we’ve documented what happens when corporations are left to decide who is or isn’t worthy of raising funds. 

In 2010, WikiLeaks suffered an extra-legal financial blockade spurred on by unofficial government pressure, though they had not been charged with any crime in the United States. In other instances, online booksellers, fetish-oriented websites, and most recently, Pornhub, have fallen prey to the moral values of individual platforms and service providers.

In fact, those most often affected by the whims of payment processors are some of the most marginalized groups and individuals. Sex workers have reported being systematically redlined by PayPal, crowdfunding sites, and even Visa and MasterCard—even when attempting to use those services for ordinary transactions unrelated to their work.

Payment companies are also notoriously overbroad in their attempts to apply restrictions related to United States international sanctions, banning individuals for so much as referencing the name of a sanctioned country like Syria, Sudan, or Iran.

The Right to a Fair Trial

In the United States, every state operates what is called an “Interest on Lawyer Trust Account” (IOLTA) program. Lawyers are required to create a separate trust account to hold their clients’ funds, which then can be used to cover the cost of legal services. This money is held separately from the attorney’s own money. In fact, a common way individuals other than the defendant contribute money to someone’s legal defense is by contributing directly to the IOLTA account. In some circumstances, these accounts are pooled and the bank’s interest payments help support legal aid to the poor and to improve the justice system. But, IOLTA accounts are not ideal: the defendant must have already secured a lawyer before using that attorney’s IOLTA account.  Moreover, it can be complex to directly transfer money to the account, and attorneys may ask that money be sent through direct transfer using a routing number or by mailing a check.  For individuals who are still seeking legal aid, or for anyone who wants to set up online donations, crowdfunding platforms have filled a vital gap—creating an online fund that can then be sent to the IOLTA account once the attorney is retained. 

While it’s understandable that, in the wake of the Capitol Hill riot, people are grasping for ways to limit the spread of right-wing extremism, the demand that companies prevent individuals from raising funds for a legal defense is deeply troubling. Our adversarial judicial system is built on the idea that people—even guilty people—should have access to a fair trial with adequate representation. In a criminal case, that ideal is often elusive, with the government having nigh unlimited resources, especially for a high profile case, while most defendants have few resources at all.  

Demanding that companies deny individuals the ability to effectively raise funds for a defense attorney tilts the playing field from the start. People would be outraged if, for instance, protesters detained during last summer’s Black Lives Matter demonstrations were de-platformed by fundraising sites. But that’s precisely what can happen when these decisions are left to corporations with one eye on the bottom line.

Make no mistake: many of the Capitol Hill rioters violated the law, and will likely—and rightfully—face legal consequences for their actions. What was so reprehensible about the Capitol Hill riot was that it attempted to undermine one of the foundational pillars of our democracy: a fair and just election. But just as democratic elections are fundamental to our society, so is a functional and fair judicial system. When we erect barriers between a defendant and the ability to pay for adequate legal representation, we jeopardize that judicial system. And while many abhor the actions of the Capitol Hill rioters, we must remember that these systems will not only be used against people whose actions we find abhorrent. Indeed, whenever we analyze the censorship decisions of tech companies, we must remember that those most likely to suffer the consequences are those already marginalized in our society.

Free as in Climbing: Rock Climber’s Open Data Project Threatened by Bogus Copyright Claims

Rock climbers have a tradition of sharing “beta”—helpful information about a route—with other climbers. Giving beta is both useful and a form of community-building within this popular sport. Given that strong tradition of sharing, we were disappointed to learn that the owners of an important community website, MountainProject.com, were abusing copyright to try to shut down another site OpenBeta.io. The good news is that OpenBeta’s creator is not backing down—and EFF is standing with him.

Viet Nguyen, a climber and coder, created OpenBeta to bring open source software tools to the climbing community. He used Mountain Project, a website where climbers can post information about climbing routes, as a source of user-posted data about climbs, including their location, ratings, route descriptions, and the names of first ascensionists. Using this data, Nguyen created free, publicly available interfaces (APIs) that others can use to discover new insights about climbing—anything from mapping favorite crags to analyzing the relative difficulty of routes in different regions—using software of their own.

Rock climbers get a lot of practice at falling hard, taking a moment to recover, and continuing to climb. Mountain Project should take a lesson from their community: dust off, change your approach, and keep climbing.

The Mountain Project website is built on users’ contributions of information about climbs. Building on users’ contributions, Mountain Project offers search tools, “classic climbs” lists, climbing news links, and other content. But although the site runs on the contributions of its users, Mountain Project’s owners apparently want to control who can use those contributions, and how. They sent a cease-and-desist letter to Mr. Nguyen, claiming to “own[] all rights and interests in the user-generated work” posted to the site, and demanding that he stop using it in OpenBeta. They also sent a DMCA request to GitHub to take down the OpenBeta code repository.

As we explain in our response, these copyright claims are absurd. First, climbers who posted their own beta and other information to Mountain Project may be surprised to learn that the website is claiming to “own” their posts, especially since the site’s Terms of Use say just the opposite: “you own Your Content.”

As is typical for sites that host user-generated content, Mountain Project doesn’t ask its users to hand over copyright in their posts, but rather to give the site a “non-exclusive” license to use what they posted. Mountain Project’s owners are effectively usurping their users’ rights in order to threaten a community member.

And even if Mountain Project had a legal interest in the content, OpenBeta didn’t infringe on it. Facts, like the names and locations of climbing routes, can’t be copyrighted in the first place. And although copyright might apply to climbers’ own route descriptions, OpenBeta’s use is a fair use. As we explained in our letter:

The original purpose of the material was to contribute to the general knowledge of the climbing community. The OpenBeta data files do something more: Mr. Nguyen uses it to help others to learn about Machine Learning, making climbing maps, and otherwise using software to generate new insights about rock climbing.

In other words, a fair use.

Rock climbers get a lot of practice at falling hard, taking a moment to recover, and continuing to climb. Mountain Project blew it here by making legally bogus threats against OpenBeta. We hope they take a lesson from their community: dust off, change your approach, and keep climbing.

Government Agencies Are About To Disclose What They Know About UFOs, And That Will Be A Dramatic Paradigm Shift

Do you believe in UFOs?  Decades ago, if you answered yes to such a question many would have considered you to be a nutjob.  But at this point UFOs are not a “conspiracy theory” any longer.  In fact, even the U.S. government is admitting that they exist, and in just a few weeks we may learn a whole lot more about what the U.S. government really knows about this phenomenon.  When President Trump signed a 2.3 trillion dollar COVID relief bill last December, it contained a provision which requires all U.S. intelligence agencies to submit an unclassified report to Congress that reveals all that they know about UFOs

In December 2020, President Trump signed a coronavirus relief bill that included an interesting stipulation – the bill set into motion an 180-day time frame in which US intelligence agencies must tell Congress everything they know about UFO sightings, via an unclassified report.

Remarkably, in what sounds like the opening crawl of an unimaginative sci-fi film, the report must also include an analysis as to whether or not UFOs pose a threat to national security (perhaps, one day, our puny, primitive weapons will be used to “bring democracy” to a space-faring civilization).

Unfortunately, U.S. intelligence agencies insisted that 180 days did not give them enough time, and so now the report is expected to be released somewhere around June 1st.

But it is coming, and the COVID relief bill was very specific about what it must include

The report will include all data found through “geospatial intelligence, signals intelligence, human intelligence and measurement and signals intelligence.” Classified information held by the Office of Naval Intelligence, the Unidentified Aerial Phenomena Task Force and the FBI will be included as well.

It will be fascinating to see what actually ends up in this report.

Personally, I don’t think that the intelligence agencies will come even close to revealing everything that they know.  But the fact that former Director of National Intelligence John Ratcliffe was willing to share so much information during an interview with Maria Bartiromo on Friday seems like a good sign.  According to Ratcliffe, there have been “sightings all over the world”

Ratfcliffe said some UFO sightings have been declassified in the past, but a report to be released by the Pentagon and other federal agencies will present more information to the American people.

“There have been sightings all over the world,” Ratcliffe said. “And when we talk about sightings, the other thing I will tell you, it’s not just a pilot or just a satellite or some intelligence collection. Usually, we have multiple sensors that are picking up these things.”

Yes, it is definitely quite true that there have been sightings all over the planet, but Esri has released an animated map that shows that more UFO sightings happen in the United States than anywhere else by a good margin.

During his interview, Ratcliffe also admitted that some of the things that UFOs do are “difficult to explain”, and that includes “traveling at speeds that exceed the sound barrier without a sonic boom”

“Frankly, there are a lot more sightings than have been made public. Some of those have been declassified. And when we talk about sightings, we are talking about objects that have been seen by Navy or Air Force pilots, or have been picked up by satellite imagery, that, frankly, engage in actions that are difficult to explain, movements that are hard to replicate, that we don’t have the technology for, or traveling at speeds that exceed the sound barrier without a sonic boom.”

Of course videos that the U.S. Navy has previously released have already confirmed the fact that UFOs often perform aerial feats that human pilots simply cannot match

Videos from the Navy were released last year through the Freedom of Information Act that showed UFOs moving at incredible speeds and performing seemingly impossible aerial maneuvers.

One of the videos was shot in November 2004; the other two were shot in January 2015. The three videos were code-named ‘FLIR1,’ ‘Gimbal,’ and ‘GoFast.’

In the 2015 videos, Navy pilots can be heard expressing disbelief. All three UFO videos were captured by Navy F/A-18 Super Hornets.

If UFOs can perform “seemingly impossible aerial maneuvers”, that would seem to suggest that whoever is piloting them is even more technologically advanced than we are.

I am entirely convinced that the U.S. government knows a great deal about UFOs and those that are flying them, and millions of Americans are very much looking forward to the release of the upcoming unclassified report.

U.S. government agencies will certainly not tell us everything, but I do believe that they will reveal more details than they ever have before.

Ultimately, I believe that the stage is being set for a great deception of epic proportions, and that is why I am starting to write more about the UFO phenomenon.

As more information is shared with the public, the narrative will be that UFOs are “spacecraft” that contain “aliens” from another planet.

And I think that it is quite likely that officials will insist that they are “friendly” and that we should be open to “learning” from them.

But the truth is that they are definitely not our “friends”.

As humanity moves into the darkest hours that it has ever known, people will become increasingly desperate for someone to come along and save us.

And if “aliens” were to show up with technology that we do not currently possess, many would be tempted to embrace them as “saviors”.

For decades, Hollywood has been relentlessly priming us for such a scenario, and now the U.S. government is starting to publicly acknowledge that UFOs aren’t just science fiction.

This is a story that is going to become increasingly important over the next few years, and it isn’t going to end well.

Now they are going to start flying migrants to red states “near the Canadian border”

The crisis on the border continues to get even worse, and our existing facilities on the southern border just aren’t equipped to handle the vast torrent of migrants that are flooding in.  So in an attempt to deal with overloaded conditions, the Biden administration plans to start flying migrants that have been detained to facilities “near the Canadian border” for processing.  Fox News is reporting that this is something that the Biden administration “is considering”, but their own report admits that CBP has already requested plane support from ICE

As crossings along the southern border surge to near-record levels, the Biden administration is considering flying migrants to states near the Canadian border, according to a report.

Customs and Border Protection (CBP) requested the plane support from Immigrations and Customs Enforcement (ICE) Friday after 1,000 migrant families and unaccompanied minors crossed the Rio Grande into South Texas Friday morning, Department of Homeland Security (DHS) officials told The Washington Post. Border agents still have another 1,000 migrants they were unable to process last night, according to communications reviewed by the Post.

Those crossing the southern border are unlikely to be carrying appropriate clothing for cold weather climates.

So will the U.S. government provide clothing for them?

According to the Fox News story that I quoted above, Montana, South Dakota and Michigan are some of the states where migrants could be relocated

That crisis was during the warmer months, and it’s not clear whether CBP will be able to provide warmer clothing for families sent to states like Michigan, South Dakota and Montana. These facilities also have far fewer resources to take in migrants. The email seen by The Post indicates CBP has not yet decided which facilities will take in the migrants.

If a steady stream of migrants is flown into these states from this point forward, there is a very important question that we need to ask.

Will the government fly them back once they are processed, or will they be released into the local communities of those northern states?

What we do know is that on the southern border CBP is starting to release migrants into the country after they have been processed without even giving them court dates

A senior-level law enforcement source with U.S.Customs and Border Protection (CBP) in the Rio Grande Valley revealed the implementation of a plan to release migrant families soon after apprehension. The plan radically changes how illegal migrants have been processed in the past and orders Border Patrol agents to quickly release migrant families without notifying the immigration courts or issuing a Notice to Appear.

“This is insane, it is another pull factor that will overwhelm us,” a CBP official with knowledge of the plan told Breitbart Texas anonymously because he is not authorized to speak publically on the matter. “We are creating another entirely different class of aliens we will have to deal with years from now. We will never find most of these aliens once they are released.”

Yikes!

Even if migrants are given court dates, most of them never come back anyway.

But now those that are not even being given any court dates at all will be free to travel the country at will

Without a Notice to Appear, the migrants are free to travel about the country and are not officially placed into the immigration court system. The court cannot order the removal of a migrant in absentia for failing to appear for a future court date, the source explained. the existence of a removal in absentia order from the court allows immigration officials to remove the alien without appeal if they are later encountered. Under this new process, the migrants will not have a removal in absentia order for failure to appear officials issued no order to appear under the unprecedented plan put in place by the Biden administration on Sunday morning.

Once news of this gets out, it will just encourage even more migrants to storm the border.

As it stands, our facilities are already beyond overloaded.  If you doubt this, just consider what Senator Chris Murphy just witnessed during his visit to a CBP facility…

Just left the border processing facility. 100s of kids packed into big open rooms. In a corner, I fought back tears as a 13 yr old girl sobbbed uncontrollably explaining thru a translator how terrified she was, having been separated from her grandmother and without her parents.

What a nightmare.

Biden insists that the “challenge” on the border is not his fault, but some migrants are openly telling reporters that they would not have come if Donald Trump was still president…

ABC News anchor Martha Raddatz recently spoke with a Brazilian man — just one of the tens of thousands of migrants who are traveling to the U.S. in search of asylum — who admitted that Biden’s presidency was a motivating factor for coming to America.

“Would you have tried to do this when Donald Trump was president?” Raddatz asked.

“Definitely not. Definitely. We have a chance, you know. The same environment that’s been going on today wasn’t there last year,” the man responded. “We used to watch the news and I definitely wouldn’t do this.”

But now Democrats are in control, and that will be the case for at least the next four years.

As a result, one migrant told Fox News that the flood of people coming over our southern border is “not going to stop, ever”

The migrant, who was not named, spoke to Fox News on Friday in El Paso after being apprehended by Customs and Border Protection (CBP).

Asked if he believes more migrants will come to the US under the Biden administration, he said with a shrug: ‘It’s not going to stop, ever. It’s not going to stop.’

Sadly, these migrants don’t understand that they are actually going from the frying pan to the fire.

Yes, things may have been really bad in the countries that they are coming from, but conditions in the United States will eventually be even worse.

Many migrants truly believe that life will be so much better if they can just get to America, but that dream is just a mirage.

But for now that dream remains a very powerful pull, and the crisis on the border is not going away any time soon.

Warmonger Joe Biden Seems Quite Eager To Start A War With Russia

If you are the president of the United States and you want to have a positive relationship with another country, it is probably not a good idea to call the leader of that other country a “killer” that “doesn’t have a soul”.  Also, it is probably not a good idea to accuse the other country of directly interfering in our elections or to threaten them with cyberattacks.  Unfortunately, Joe Biden seems to think that the American people want him to “get tough” with Russia, and he just told ABC’s George Stephanopoulos that Vladimir Putin “will pay a price” for messing with the 2020 election…

President Joe Biden said Vladimir Putin “will pay a price” for his efforts to undermine the 2020 US election following a landmark American intelligence assessment which found that the Russian government meddled in the 2020 election with the aim of “denigrating” Biden’s candidacy.

“He will pay a price,” Biden said of Putin in an interview that aired Wednesday on ABC’s “Good Morning America”. “We had a long talk, he and I, and relatively well. And the conversation started — ‘I know you and you know me. If I establish this occurred, be prepared.’”

After the 2016 election, we had to endure years of baseless claims that Donald Trump “colluded with the Russians”, and those claims were eventually completely discredited.

But now here we go again.

Even though Trump lost, Biden and the Democrats are once again convinced that the Russians interfered with the election.  In fact, White House Press Secretary Jen Psaki is claiming the the Russians have interfered with our elections “for many years”

‘President Biden has been clear that the United States will also respond to a number of destabilizing Russian actions,’ she continued, adding there are several new investigations related to relations with the Kremlin.

‘The Russians have intervened, or attempted to intervene, in elections for many years – I mean, long before 2016. We certainly are eyes-wide-open about that and fully aware of that,’ Psaki said.

Long before 2016?

How far back do they think this goes exactly?

When George Stephanopoulos pressed Biden on specifically what he planned to do to Russia, Biden responded by saying “you’ll see shortly”

When pushed on what the consequences would be, the president said: ‘The price he’s going to pay, well, you’ll see shortly.’

Let us hope that what Biden means is that more sanctions will be imposed.  After all of the sanctions that have already been slapped on Russia, there isn’t much more damage that can be done in that area.

Unfortunately, it appears that Biden is preparing to go way beyond just imposing sanctions.

In fact, the New York Times recently reported that the Biden administration is preparing a series of cyberattacks against Russia

Russia has expressed its alarm after it was reported the United States was planning a series of covert counterattacks on Russian networks, saying such strikes would amount to cybercrimes.

The report by The New York Times on March 7 said the planned US move would be in response to the hacking of SolarWinds software that US officials say was conducted by Russia, something Moscow denies.

“This is alarming information,” Dmitry Peskov, Kremlin spokesman, said on Tuesday. “This would be pure international cybercrime.”

Actually, a cyberattack is an act of war, and everyone needs to understand that.

If the Russians were conducting cyberattacks against us, they deserve to be hit back.

But so far I have not seen any evidence at all that indicates that this is the case.

During his interview with Stephanopoulos, Biden also decided that it would be okay to directly insult Putin several times

‘So you know Vladimir Putin. You think he is a killer?’ Stephanopoulos asked Biden.

He responded: ‘Uh-huh, I do.’

A bit earlier, the ABC anchor pointed out: ‘You said you know he doesn’t have a soul.’

‘I did say that to him, yes,’ the president affirmed.

That is not exactly the way to promote a positive relationship between our two nations.

In fact, this is the kind of language that often leads to war.

In response to Biden’s interview, the Russians have called their ambassador back to Moscow

Russia on Wednesday called its ambassador to the United States back to Moscow for consultations on the future of U.S.-Russia ties after U.S. President Joe Biden said Vladimir Putin would “pay a price” for alleged election meddling.

Biden made his comments after a U.S. intelligence report supported longstanding allegations that Putin was behind Moscow’s election interference in the United States, an accusation Russia called baseless.

That is a pretty dramatic step, but it is probably only the beginning.

If the U.S. starts hitting the Russians with cyberattacks, the Russians will have a decision to make.

They could just sit back and absorb the cyberattacks, or they could choose to strike back.

Personally, I believe the Russians would choose the latter of the two options.

If that happens, then the Biden administration will have a choice to make.

Needless to say, things could eventually escalate to the point of no return.

Meanwhile, the Biden administration is also pushing us toward war in the Middle East.  The Russians are still heavily engaged in Syria, and now that U.S. troops have rolled into the country things could spiral out of control very easily.  This is something that I covered in a previous article entitled “9 Signs That Chess Pieces Are Being Moved Into Place For A Major War In The Middle East”.

Many Americans have assumed that since Biden has so much “foreign policy experience” that he must be well qualified to deal with the leaders of other nations.

But the truth is that Biden has always been a hothead with a violent temper that can erupt at any moment.  This is something that we witnessed repeatedly on the campaign trail.

He is definitely not the kind of man that we need in the White House, and his warmongering is going to push us closer to war with each passing day.

There Is A “Crisis Of Masculinity” In The United States

When I was growing up in the 1970s, society was definitely beginning to change, but there were still plenty of men that knew how to be men.  In those days, if men wanted to be masculine that was okay.  And if women wanted to be feminine, that was okay too.  But now everything has completely changed.  Any effort to promote traditional gender roles is frowned upon, and masculinity in particular is under attack.  In our society, “male” has become a label with highly negative connotations, and if you exhibit masculine traits you are considered to be part of the problem.  Sadly, these negative messages about masculinity are constantly reinforced by the countless hours that Americans spend watching television and movies each year.

Whether they consciously realize it or not, men are continuously being told that they must change in order to be acceptable to society.

Masculinity has not been abolished, but it is being twisted, reshaped and redefined.  The term “toxic masculinity” is code for how men used to behave in the old days, and those that embrace the old values are portrayed as villains.  For an example of what I am taking about, just watch the Gillette television commercial entitled “We Believe: The Best Men Can Be”.  They don’t even try to hide what they are attempting to do, because there is no need to do so.  Our society has rejected traditional masculinity to such an extent that it can now be assaulted freely and openly.

Yes, a small percentage of old timers might get upset, but those that dominate our culture understand that young people are our future.

Speaking of young people, our system of education overwhelmingly favors female traits.  Boys are designed to be warriors and adventurers, and so sitting still at their desks and discussing their feelings all day does not come naturally to them.

Only 11 percent of our elementary school teachers are male, and that certainly doesn’t help either.  Throughout their school years, boys are constantly encouraged to behave more like girls, and traditional male behavior is steadily drummed out of them.

This system is not working for young males, and the numbers tell us this very clearly.

Just check out these statistics.  For every 100 girls in the same category, there are…

  • 145 boys who repeat kindergarten
  • 168 boys with communication disorders
  • 180 boys who abuse drugs and alcohol
  • 207 boys classified as having a learning disability
  • 318 boys who die by overdose
  • 237 boys diagnosed with ADHD
  • 240 boys suspended from school
  • 291 boys expelled from school
  • 355 boys in public schools classified with emotional disturbance
  • Boys over 14 are 4x more likely to die by suicide

Those numbers are absolutely staggering.

But the corporate media will never talk about them, because it isn’t politically correct to talk about a “crisis of masculinity” in the United States.

Not too long ago, the Brookings Institution conducted a study that found that more U.S. parents are concerned about their sons than they are about their daughters…

Americans are more worried about boys in general. Forty-one percent agree or strongly agree with the statement “I am worried about boys in the United States becoming successful adults, compared to 33% saying the same for girls. 

In particular, the study discovered that most parents believe that their daughters exhibit more resilience than their sons do

Parents are asked about how well their son(s) and/or daughter(s) cope with setbacks, intended as a measure of resilience, “stick-with-it-ness,” or grit. Parents see their daughters as more resilient, with 66% agreeing that “setbacks don’t discourage her. She doesn’t give up easily,” compared to 58% saying the same for their sons. Conservatives report higher levels of resilience in their children than liberals overall, and see a somewhat smaller gap in resilience between their sons and daughters on this question. Only half of liberal parents (50%) agree that their son is resilient, compared to 63% saying the same for their daughters, consistent with the higher levels of worry about sons among liberal parents reported above.

Are we raising an entire generation of young males that are not equipped to handle the tough challenges that real life will inevitably throw at them?

I think that is a fair question.

One of the primary reasons why our boys are not doing well is because so many of them are being raised without their fathers.  One recent survey found that an all-time record low 68.9 percent of U.S. children are being raised in a home that does not include two parents.

That is nearly a third of all American children.

Of course when a parent is missing, it is almost always the father.

And studies have shown that boys that are raised in a home without a father are much more likely to commit serious crimes

The absence of fathers leads to more crime and more poverty. Society should be honoring the importance of fathers and intact families, but instead they promote, normalize, and encourage the further destruction of the family. 93% of our inmates are male, and 90% grew up without a father.

The nuclear family has been one of the fundamental building blocks of every great society throughout human history because the nuclear family works.

But now our social engineers intend to turn everything upside down.

In America today, any values that are “traditional” are bad, and new “values” that are the complete opposite of what Americans once believed are now considered to be “good”.

We have completely lost our way as a society, and if we stay on this path it will end in disaster.

But there isn’t much hope of turning things around, because people like me and you are not running things anymore.

At this point the inmates are running the asylum, and with each passing day the fabric of our society is coming apart a little bit more.

10 Examples That Show How Nightmarish The Worst Border Crisis In Modern American History Has Become

If U.S. Customs and Border Protection personnel are intercepting more than 100,000 migrants a month as they try to illegally cross the southern border, how many more are able to make it through undetected?  In recent days, there has been a whole bunch of news stories about the nightmarish border crisis that we are currently facing.  Now that President Trump is out of the White House, vast numbers of migrants have been flooding toward our southern border over the past couple of months.  They are desperate for a better life, and the perception that Joe Biden is implementing “open border policies” gives them hope that they will be allowed in.

But when they try to cross the border, approximately 70 percent of those that are intercepted by CBP are turned away

Customs and Border Protection officers have encountered over 100,000 migrants at the border in February alone, highlighting how overwhelming the situation has become.

The vast majority of migrants – around 70%, according to one source – are expelled via public health order Title 42 that allows authorities to quickly return migrants to their country of travel.

But of course countless more migrants are making it in through gaps in our porous border security.  When the Daily Mail sent a team down to the Rio Grande, they witnessed traffickers bringing migrants across the river over and over again

As the night drew on, this brief, chaotic encounter was repeated again and again as scores of migrants crossed one of the narrowest sections of the Rio Grande with virtual impunity.

Over a two-hour period we watched in disbelief as the three-man trafficking crew made five drop-offs, cramming as many as ten people into a boat designed for four.

Of the 96 newcomers they dumped onto a slippery riverbank in Roma, an hour’s drive west of McAllen, 13 were unaccompanied children, including sisters aged five and 12.

This sort of thing is happening at various points along the southern border night after night, and yet nothing is done to stop it.

Of course CBP personnel can’t be everywhere, and without a doubt they have their hands full on a constant basis.

Thanks to the “catch and release” policy that has been instituted by the Biden administration, many of those that the CBP is able to detain are processed and then released into the country

Under Biden’s revisions, single men and women will still be sent back but families with young children will be taken to a Border Patrol facility, processed and released with an I-862 form – a notice to appear before an immigration court at a later date.

Needless to say, only a very small percentage of those migrants ever show up at immigration court.

It is an absolutely disastrous policy, and Biden administration officials know this.

But they just keep doing it anyway.

U.S. Customs and Border Protection is the agency that is tasked with protecting our borders, and their job has become a complete and utter nightmare.

The following are 10 quotes that come directly from the official CBP Twitter account that demonstrate how bad the crisis on the border has now become…

“In February, CBP encountered 100,441 persons attempting entry along the SW border. This is a 28% increase over January.”

“Laredo Sector Border Patrol agents apprehended multiple people attempting to illegally enter the U.S. through the Rio Grande River. Several individuals drifted back to the Mexican side of the river on inner tubes.”

“Border Patrol agents conducting a train check found 16 people inside of a storage container after discovering that the seal from the storage container’s door had been broken. The group was from Guatemala, Honduras and Mexico.”

“#USBP agents assigned to the Laredo North Station apprehended 111 individuals during three separate human smuggling attempts involving commercial trailers north of Laredo, Texas.”

“Within a 12-hour period, the Laredo Sector Border Patrol Horse Patrol Unit apprehended 125 individuals in 3 different human smuggling attempts”

“Over the weekend, @CBPRGV Border Patrol agents assigned to the Rio Grande City Station encountered two large groups crossing into the U.S., leading to the apprehension of 247 individuals from Honduras, El Salvador, Guatemala, Nicaragua and Romania.”

“On Wednesday, CBP officers in Laredo seized 28 containers manifested as acrylic paint, holding a total of 1,234lbs of meth. The estimated street value of the seizure is over $24M.”

“CBP agents and officers have seized more than 75,100lbs of methamphetamine during the first five months of FY21, a 9% increase over the same time last year.”

“CBP agents and officers have seized more than 43,300lbs of cocaine during the first five months of FY21, a 64% increase over the same time last year.”

“CBP agents and officers have seized more than 4,900lbs of fentanyl during the first five months of FY21, already surpassing the total for all of FY20.”

In January, the number of migrants intercepted by CBP was about twice the level that was reported in January 2020.

And then as you just read about above, the number of migrants intercepted in February was 28 percent higher than January.

What is going to happen if the numbers just keep going up like this?

According to one CBP source, the number of migrants has gone “from a trickle to a torrent” since Biden entered the White House…

But as a well-placed Border Patrol source told us under condition of anonymity: ‘The cartels don’t know or care what the actual policies or politics are.

‘They just tell the migrants that Biden will let them stay and the migrants believe it because that’s the rhetoric he used on the campaign trail.

‘The numbers have exploded since he took office. It went from a trickle to a torrent.’

What is really ironic is that this is about the worst possible time to be moving into the United States, but of course the migrants that are trying to come in illegally don’t realize this.

Most of them truly believe that life will be so much better if they can just get to America, and many of them are willing to go to extreme lengths to get across the border.

Brave CBP officials will continue to do their jobs, but the Biden administration will continue to undermine them at every turn, and that means that the crisis at the border is not going away any time soon.

Rewriting Intermediary Liability Laws: What EFF Asks – and You Should Too

Rewriting the legal pillars of the Internet is a popular sport these days. Frustration at Big Tech, among other things, has led to a flurry of proposals to change long-standing laws, like Section 230, Section 512 of the DMCA, and the E-Commerce Directive, that help shield online intermediaries from potential liability for what their users say or do, or for their content moderation decisions.

If anyone tells you revising these laws will be easy, they are gravely mistaken. For decades, Internet users – companies, news organizations, creators of all stripes, political activists, nonprofits, libraries, educators, governments and regular humans looking to connect – have relied on these protections. At the same time, some of the platforms and services that help make that all possible have hosted and amplified a great deal of harmful content and activity. Dealing with the latter without harming the former is an incredibly hard challenge. As a general matter, the best starting point is to ask: “Are intermediary protections the problem? Is my solution going to fix that problem? Can I mitigate the inevitable collateral effects?” The answer to all three should be a firm “Yes.” If so, the idea might be worth pursuing. If not, back to the drawing board.

That’s the short version. Here’s a little more detail about what EFF asks when policymakers come knocking.

What’s it trying to accomplish?

This may seem obvious, but it’s important to understand the goal of the proposal and then match that goal to its likely actual impacts. For example, if the stated goal of the proposal is to “rein in Big Tech,” then you must consider whether the plan might actually impede competition from smaller tech companies. If the stated goal is to prevent harassment, then we want to be sure the proposal won’t discourage platforms from moderating their content to cut down on harassment, and to consider whether the proposal will encourage overbroad censorship of non-harassing speech. In addition, we pay attention to whether the goal is consistent with EFF’s mission: to ensure that technology supports freedom, justice, and innovation for everyone.

Is it constitutional?

Too many policymakers seem to care too little about this detail – they’ll leave it for others to fight it out in the courts. Since EFF is likely to be doing the fighting, we want to plan ahead – and help others do the same. Call us crazy, but we also think voters care about staying within the boundaries set by the Constitution and also care about whether their representatives are wasting time (and public money) on initiatives that won’t survive judicial review.

Is it necessary – meaning, are intermediary protections the problem?

It’s popular right now to blame social media platforms for a host of ills. Sometimes that blame is deserved. And sometimes it’s not. Critics of intermediary liability protections too often forget that the law already affords rights and remedies to victims of harmful speech when it causes injury, and that the problem may stem from the failure to apply or enforce existing laws against users who violate those laws. State criminal penalties apply to both stalking and harassment, and a panoply of civil and criminal statutes address conduct that causes physical harm to an individual. Moreover, if an Internet company discovers that people are using its platforms to distribute child sexual abuse material, it must provide that information to the National Center for Missing and Exploited Children and cooperate with law enforcement investigations. Finally, law enforcement sometimes prefers to keep certain intermediaries active so that they can better investigate and track people who are using the platform to engage in illegal conduct.

If law enforcement lacks the resources they need to follow up on reports of harassment and abuse, or lacks clear understanding or commitment to enforcing those problems when they come up in the digital space, that’s a problem that needs fixing, immediately. But the solution probably doesn’t start or end with a person screening content in a cubicle, much less an algorithm attempting to do the same.

In addition to criminal charges, victims can use defamation, false light, intentional infliction of emotional distress, common law privacy, interference with economic advantage, fraud, anti- discrimination laws, and other civil causes of action to seek redress against the original author of the offending speech. They can also sue a platform if the platform owner is itself authoring the illegal content.

As for the platforms themselves, intermediary protections often contain important exceptions. To take just a few examples: Section 512 does not limit liability for service providers’ own infringing activities, and requires them to take action when they have knowledge of infringement by their users. Section 230 does not provide immunity against prosecutions under federal criminal law, or liability based on copyright law or certain sex trafficking laws. For example, backers of SESTA/FOSTA, the last Section 230 “reform,” pointed to Backpage.com as a primary target, but the FBI shut down the site without any help from that law. Nor does Section 230 provide immunity against civil or state criminal liability where the company is responsible, in whole or in part, for the creation or development of information. Nor does Section 230 immunize certain intermediary involvement with advertising, e.g., if a platform requires advertisers to choose ad recipients based on their protected status.

Against this backdrop, we ask: are intermediaries at fault here and, if so, are they beyond the reach of existing law? Will the proposed change help alleviate the problem in a practical way? Might targeting intermediaries impede enforcement under existing laws, such as by making it hard for law enforcement to locate and gather evidence about criminal wrongdoers?

Will it cause collateral damage? If so, can that damage be adequately mitigated?

As a civil liberties organization, one of the main reasons EFF defends limits on intermediary liability is because we know the crucial role intermediaries play in empowering Internet users who rely on those services to communicate. Attempts to change platform behavior by undermining Section 230 or Section 512, for example, may actually harm lawful users who rely on those platforms to connect, organize, and learn. This is a special risk to the historically marginalized communities that often lack a voice in traditional media and who often find themselves improperly targeted by content moderation systems. The ultimate beneficiaries of limits on intermediary liability are all of us who want those intermediaries to exist so that we can post things without having to code and host it ourselves, and so that we can read, watch, and re-use content that others create.

Further, we are always mindful that intermediary liability protections are not limited to brand name “tech companies,” of any size. Section 230, by its language, provides immunity to any “provider or user of an interactive computer service” when that “provider or user” republishes content created by someone or something else, protecting both decisions to moderate it and those to transmit it without moderation. “User,” in particular, has been interpreted broadly to apply “simply to anyone using an interactive computer service.” This includes anyone who maintains a website that hosts other people’s comments, posts another person’s op-ed to message boards or newsgroups, or anyone who forwards email written by someone else. A user can be an individual, a nonprofit organization, a university, a small brick-and-mortar business, or, yes, a “tech company.” And Section 512 protects a wide ranges of services, from your ISP to Twitter to the Internet Archive to a hobby site like Ravelry.

Against this backdrop, we ask: Who will be affected by the law? How will they respond?

For example, will intermediaries seek to limit their liability by censoring or curtailing lawful speech and activity? Will the proposal require intermediaries to screen or filter content before it is published? Will the proposal directly or indirectly compel intermediaries to remove or block user content, accounts, whole sections of websites, entire features or services? Will intermediaries shut down altogether? Will the cost of compliance become a barrier to entry for new competitors, further entrenching existing gate-keepers? Will the proposal empower a heckler’s veto, where a single notice or flag that an intermediary is being used for illegal purposes results in third-party liability if the intermediary doesn’t take action?

If the answer is yes to any of these, does the proposal include adequate remediation measures? For example (focusing just on competition) if compliance could make it difficult for smaller companies to compete or alternatives to emerge, does the proposal include mitigation measures? Will those mitigation measures be effective?

What expertise is needed to evaluate this proposal? Do we have it? Can we get it?

One of the many lessons of SESTA/FOSTA was that it’s hard to assess collateral effects if you don’t ask the right people. We asked sex workers and child safety experts what they thought about SESTA/FOSTA. They told us it was dangerous. They were right.

We take the same approach with the proposals coming in now. Do we understand the technological implications? For example, some proposed changes to Section 230 protections in the context of online advertising might effectively force systemic changes that will be both expensive and obsolete in a few years. Some might make a lot of sense and not be too burdensome for some services. Others might simply be difficult to assess without deeper knowledge of how the advertising system works now and will likely work in the future. Some implications for users might not be clear to us, so it’s especially important to seek out potentially affected communities and ensure they have a meaningful opportunity to consult and be heard on the impacts of any proposal. We try to make sure we know what questions to ask, but also to know what we don’t know.

Online Intermediary Reform Is Hard

Many intermediary liability reform proposals are little more than vaporware from policymakers who seem bent on willfully misunderstanding how intermediary protections and even the Internet work. But some are more serious, and deserve consideration and review. The above questions should help guide that process.

You Were Warned That Dust Bowl Conditions Would Return, And Now It Has Happened

The horrific drought that has much of the western half of the United States in a death grip has already surpassed what many scientists thought was possible.  Some areas of the Southwest went more than 200 straight days without any measurable rain last year, vegetation is disappearing at a frightening pace, and giant dust storms are becoming increasingly common.  For years, we have been warned that the droughts in the Southwest were getting worse.  For years, we have been warned that Dust Bowl conditions would return.  Now a nightmare scenario is upon us, and authorities are using the term “megadrought” to describe what is taking place…

The western U.S. continues to endure dry conditions, and now scientists are using the term “megadrought” to describe the problem — which has existed for decades — with no end in sight.

“A megadrought is typically a drought event that has a long duration,” Brian Fuchs, with the National Drought Mitigation Center, said to FOX Television Stations Tuesday.

The latest U.S. Drought Monitor map that has been released has such bad news that it is hard to believe.  More than 265,000 square miles of territory is currently experiencing “exceptional drought conditions”

The scope of the western drought is chilling. All of Nevada, Utah and New Mexico are in drought, according to the US Drought Monitor. Close behind are Arizona at 98.9% and Colorado at 98.6%.

More disturbing is the size of what’s called the “exceptional drought” area, according to the US Drought Monitor. Parts of Arizona, Nevada, Utah, New Mexico, Colorado, California and Texas classified as exceptional drought, total 265,200 square miles. For comparison, that is nearly equivalent to the size of Texas.

It would be difficult to overstate the severity of this crisis.  In fact, the Wall Street Journal says that this drought is already “one of the most severe on record in the Southwest”.

Approximately 40 million people depend on the water that flows through this area.  With so little snowpack this year, authorities really don’t have any idea how they are going to make it through the summer.

In February, Los Angeles, Phoenix and Yuma did not have any measurable rainfall at all.

Las Vegas had just 0.01 inch of rain for the month.

As winter ends, we will move into a part of the year when many cities may not see any precipitation at all for months on end.  Just consider what happened last year

Las Vegas had a streak of 240 days from April to December 2020 without measurable rain — a trace or less — smashing the previous record of 150 consecutive days in 1959.

Yuma, Arizona had a dry streak of 242 days last year, their third longest streak, while Phoenix was dry a consecutive 110 days. Bishop and Needles, California, also had record dry streaks of over 200 days without measurable rainfall.

Read that first sentence again.

Las Vegas broke their old record by a whopping 90 days last year.

We are in unprecedented territory, and the drought just keeps getting worse.

According to climatologist Brian Fuchs, the epicenter of this drought is in the Four Corners area

“The Four Corners [Arizona, New Mexico, Colorado and Utah] is the epicenter of this drought,” said Brian Fuchs, climatologist at the National Drought Mitigation Center at the University of Nebraska. “When droughts like this happened long ago, the people living there just had to move.”

As existing supplies of water become more strained than ever before, could we potentially get to a point where large numbers of people will be forced to migrate once again?

It could happen.

This endless drought is also creating ideal conditions for giant dust storms.  Just the other day, an enormous dust storm caused a horrifying multi-vehicle crash in Arizona

The multi-vehicle crash happened late Wednesday afternoon on eastbound I-10 near the intersection of State Route 87.

The dust made things tough for crews from the Eloy Fire District, who were trying to help multiple people. As the firefighters and paramedics worked, they had to deal with zero-visibility dust storm conditions. Photos provided by the department showed thick dust blowing in the area, and crew members trying to shield their faces.

Sadly, such dust storms are becoming a regular occurrence in the western half of the nation.  In fact, a few months ago there was a dust storm that was so large that it could be seen from space

Earlier this month, a storm front swept across the Great Plains of the United States, plowing up a wall of dust that could be seen from space, stretching from eastern Colorado into Nebraska and Kansas. It was a scene straight from the Dust Bowl of the 1930s, when farmers regularly saw soil stripped from their fields and whipped up into choking blizzards of dust.

Better get used to it. According to a new study, dust storms on the Great Plains have become more common and more intense in the past 20 years, because of more frequent droughts in the region and an expansion of croplands. “Our results suggest a tipping point is approaching, where the conditions of the 1930s could return,” says Gannet Haller, an atmospheric scientist at the University of Utah who led the study.

Needless to say, these conditions are making it extremely difficult for farmers to grow anything.

In fact, thousands of farmers in New Mexico have already taken at least some of their acres out of production for 2021…

Gary Esslinger, treasurer-manager of the district in Las Cruces, New Mexico, told WSJ that his area’s conditions are absolutely “horrific.” He said at least 33% of the 6,500 farmers in his region had taken offline 90,640 irrigable acres out of production from previous drought years.

New Mexico State Engineer John D’Antonio Jr. has requested farmers not to plant this year due to dangerously low levels at the state’s reservoirs.

Other farmers are going to try to operate normally, but they know that the outlook is extremely bleak.

New Mexico farmer Travis Harris understands what he is potentially facing, and he says that it is “very scary going into this season”

Harris is all too familiar with this. He said he didn’t get his full water allotment in 2020. Last fall, he said, his water got shut off a month early. He keeps a close eye on the conditions high in the mountains, too, knowing how deeply they affect him.

“There’s no snowpack. There’s no water in storage up north,” Harris said. “It’s very scary going into this season.”

I have been writing about the drought in the Southwest for years, and this is the worst that I have ever seen it by a wide margin.  If conditions continue to deteriorate, that will have very serious implications for all of us.

Unfortunately, experts are expecting 2021 to be another exceedingly dry year.

That means that this crisis isn’t going to go away any time soon, and supplies of water in the region will just continue to get tighter and tighter.

Apple and Google Kicked Two Location Data Brokers Out of Their App Stores. Good, Now Kick Them All Out.

Last fall, reports revealed the location data broker X-Mode’s ties to several U.S. defense contractors. Shortly after, both Apple and Google banned the X-Mode SDK from their app stores, essentially shutting off X-Mode’s pipeline of location data. In February, Google kicked another location data broker, Predicio, from its stores.

We’ve written about the problems with app-store monopolies: companies shouldn’t have control over what software users can choose to run on their devices. But that doesn’t mean app stores shouldn’t moderate. On the contrary, Apple and Google have a responsibility to make sure the apps they sell, and profit from, do not put their users at risk of harms like unwarranted surveillance. Kicking out two data brokers helps to protect users, but it’s just a first step. 

X-Mode and Predicio have each been the subject of reports over the past year that reveal how U.S. government agencies—including the Department of Defense and ICE—try to work around the 4th Amendment by buying location data on the private market. In 2018, the Supreme Court handed down U.S. v. Carpenter, a landmark decision which ruled that location data collected from cell phone towers is protected by the 4th Amendment. This means law enforcement can’t get your location from your cell carrier without a warrant. 

But dozens of companies are still collecting the same location from a different source—mobile apps—and making it available to law enforcement, defense, intelligence, immigration, and other government agencies. Data brokers entice app developers to install pieces of third-party code, called SDKs, which collect raw GPS data and feed it directly to the brokers. These data brokers then resell the location feeds to advertisers, hedge funds, other data brokers, and governments all around the world.

The apps that source the data run the gamut from prayer apps to weather services. X-Mode collected data from thousands of apps including Muslim Pro, one of the most popular Muslim prayer apps in the U.S. X-Mode allegedly sold that data to several Pentagon contractors. Another broker, Predicio, collected data from hundreds of apps including Fu*** Weather and Salaat First. It then sold data to Gravy Analytics, whose subsidiary Venntel has provided location data to the IRS, CBP, and ICE.

It took many months of investigative journalism by Vice, the Wall Street Journal, Protocol, NRK Beta, and others to piece together the flow of location data from particular apps to the U.S. government. These reporters deserve our gratitude. But it’s not good enough for app stores to wait for specific data brokers to come into the public spotlight before banning them. 

We know brokers continue to mine location data from our apps and sell it to military and law enforcement—we just don’t know which apps. For example, we know that Babel Street sells its secretive Locate X product, which comprises real-time location data about untold numbers of users, to the Department of Homeland Security, the Department of Defense, and the Secret Service. This data reportedly comes from thousands of different mobile apps. 

But figuring out which apps are responsible is difficult. Laws in the U.S. generally do not require companies to disclose exactly where they sell personal data, so it’s easy for data brokers to mask their behavior. Journalists often must rely on technical analysis (which requires expertise and lots of time) and government records requests (which may take years and be heavily redacted) to piece together data flows. When investigators do discover proof of unwanted data sharing, the apps and brokers involved can just change their tactics. Even the app developers involved often don’t know where the data they share will end up. Users can’t make educated choices without knowing where or how their data will be shared. 

Google Play and the Apple App Store shouldn’t wait on journalists to establish end-to-end data flows before taking steps to protect users.

The ecosystem of phone app location data should be better regulated. Local CCOPS (community control of police surveillance) laws can ban police and other local government agencies from acquiring surveillance tech, including data broker deals, without legislative permission and community input. We support these laws, but most cities do not have them. Also, they do not address the problem of federal agencies buying our location data on the open market. We will continue pushing for legislation and judicial decisions that, as required by the Fourth Amendment, prevent the government at all levels from buying this kind of data without first getting a warrant. But in the meantime, many government agencies will continue buying location data as long as they believe they can.

App stores are in a unique position to protect tech users from app-powered surveillance. We applaud Apple and Google for taking action against X-Mode and Predicio. But this is only the tip of the iceberg. Now the app stores should take the next step: ban SDKs from any data brokers that collect and sell our location information.

There is no good reason for apps to collect and sell location data, especially when users have no way of knowing how that data will be used. We implore Apple and Google to end this seedy industry, and make it clear that location data brokers are not welcome on their app stores.

Let’s Compare The U.S. Military To The Russian Military And The Chinese Military…

A couple decades ago, the U.S. military was an unparalleled fighting machine.  Both Russia and China seemed hopelessly behind, and nobody dared to challenge America’s military superiority.  Everyone else was battling for second place in the pecking order, and they knew it.  But since that time, Russia and China have engaged in extremely aggressive modernization programs, while the U.S. military has chosen to focus on becoming more “diverse” and “inclusive”.  As a result, the balance of power has changed dramatically.

In this article, I would like to focus on a few examples that demonstrate the shift that has taken place.

For instance, the Russians are extremely excited about their new ultra-quiet Borei-class submarines that can rain death and destruction down upon their enemies from thousands of miles away

Each of the submarine’s sixteen R-30 Bulava (“Mace”) missiles typically carries six 150-kiloton nuclear warheads designed to split apart to hit separate targets. This means one Borei can rain seventy-two nuclear warheads ten times more destructive than the bomb dropped on Hiroshima on cities and military bases over 5,800 miles away.

The Borei is the most advanced SSBN in the Russian Navy, and is designed to replace its seven Soviet-era Delta-class SSBNs.

In China, scientists have been feverishly working to develop fearsome biologically-enhanced “super soldiers” that could potentially be far superior to standard western soldiers in a future war…

U.S. intelligence shows that China has conducted “human testing” on members of the People’s Liberation Army in hope of developing soldiers with “biologically enhanced capabilities,” the top U.S. intelligence official said Friday.

John Ratcliffe, the director of national intelligence, included the explosive claim in a long Wall Street Journal op-ed in which he made the case that China poses the pre-eminent national security threat to the U.S.

Meanwhile, Joe Biden says that the U.S. military is “making good progress” on feminist issues.  Some of the current priorities include “creating maternity flight suits” and loosening hairstyle requirements…

You know, some of — some of it is relatively straightforward work where we’re making good progress designing body armor that fits women properly; tailoring combat uniforms for women; creating maternity flight suits; updating — updating requirements for their hairstyles.

Of course any of the old-timers that dare to object to the new “woke military” are being purged, and so soon their won’t be any dissenting voices standing in the way of the social justice reforms that the Biden administration wishes to implement.

Over in Russia, “diversity” is not a military priority.  Instead, they are getting ready to introduce the new Sarmat intercontinental nuclear missiles into service.  These new missiles can travel at speeds of up to 15,000 mph, and a single missile has enough firepower to “wipe out Texas”

RUSSIA is poised to test an “unstoppable” 15,000 mph nuclear missile it boasts can beat any defense and wipe out Texas.

The RS-28 Sarmat doomsday rocket is now primed to replace the much-feared R-36 – once dubbed the “Satan” nuke by Nato.

The Kremlin brags it has a range of around 6,200 miles, can carry 16 warheads and is able to dodge any missile defense system.

At the same time, the Chinese are rapidly developing highly advanced missile delivery systems that look just like “standard international shipping containers”

This missile would be a land-attack variant of an advanced anti-ship missile that would be deployed in launchers appearing to be standard international shipping containers from the outside. Such containers are being used all around the world for moving millions of tons of goods, and are often placed on the deck of large freighters.

The YJ-18C is China’s version of the Club-K cruise missile built by Russia that also uses a launcher disguised as a shipping container. Israel also is working on a container-launched missile called the Lora. Rick Fisher, a China military affairs expert, said he is not surprised China is copying the Russian Club container-launched missile. “It fits with China’s penchant for seeking asymmetric advantages against its enemies,” he said.

Of course the U.S. military is modernizing as well.

In fact, it has been reported that U.S. strategic nuclear forces are no longer using 8-inch floppy disks from the 1970s…

In 2014, “60 Minutes” made famous the 8-inch floppy disks used by one antiquated Air Force computer system that, in a crisis, could receive an order from the president to launch nuclear missiles from silos across the United States.

But no more. At long last, that system, the Strategic Automated Command and Control System or SACCS, has dumped the floppy disk, moving to a “highly secure solid state digital storage solution” this past June, said Lt. Col. Jason Rossi, commander of the Air Force’s 595th Strategic Communications Squadron.

That is exciting news.

What is next?  Will they finally get rid of all of their old rotary phones?

Meanwhile, President Biden is making it exceedingly clear that the U.S. military will have a culture of “inclusiveness” from this point forward…

That’s why we moved so quickly to overturn the discriminary — discriminatory ban on transgender service, and why General Austin’s first memo was a directive to take sexual assault in the military seriously.

Every single person, no matter their gender identity, sexual orientation, race, or religious background, deserves to feel safe in the ranks and to have their contributions valued.

I could go on and on with more examples, but I think that most of you get the point.

The U.S. military is being transformed into an institution of social change, and at the same time Russia and China are tightly focused on trying to figure out how to fight and win World War III.

When it comes time to fight a real war, do you think that we will actually win?

Just because the U.S. military was overwhelmingly dominant at one time, that does not mean that it is still that way today or that it will be that way in the future.

One of the only things that is constant about our world is change, and right now the U.S. military is definitely changing in the wrong direction.

The SAFE Tech Act Wouldn’t Make the Internet Safer for Users

Section 230, a key law protecting free speech online since its passage in 1996, has been the subject of numerous legislative assaults over the past few years. The attacks have come from all sides. One of the latest, the SAFE Tech Act, seeks to address real problems Internet users experience, but its implementation would harm everyone on the Internet. 

The SAFE Tech Act is a shotgun approach to Section 230 reform put forth by Sens. Mark Warner, Mazie Hirono and Amy Klobuchar earlier this month. It would amend Section 230 through the ever-popular method of removing platform immunity from liability arising from various types of user speech. This would lead to more censorship as social media companies seek to minimize their own legal risk. The bill compounds the problems it causes by making it more difficult to use the remaining immunity against claims arising from other kinds of user content. 

Addressing Big Tech’s surveillance-based business models can’t, and shouldn’t, be done through amendments to Section 230—but that doesn’t mean it shouldn’t be done at all. 


The act would not protect users’ rights in a way that is substantially better than current law. And it would, in some cases, harm marginalized users, small companies, and the Internet ecosystem as a whole. Our three biggest concerns with the SAFE Tech Act are: 1) its failure to capture the reality of paid content online, 2) the danger that an affirmative defense requirement creates and 3) the lack of guardrails around injunctive relief that would open the door for a host of new suits that simply remove certain speech.

Section 230 Benefits Everyone

Before considering what this bill would change, it’s useful to take a look at the benefits that Section 230 provides for all internet users. The Internet today allows people everywhere to connect and share ideas—whether that’s for free on social media platforms and educational or cultural platforms like Wikipedia and the Internet Archive, or on paid hosting services like Squarespace or Patreon. Section 230’s legal protections benefit Internet users in two ways. 

Section 230 Protects Intermediaries That Host Speech: Section 230 enables services to host the content of other speakers—from writing, to videos, to pictures, to code that others write or upload—without those services generally having to screen or review that content before being published. Without this partial immunity, all of the intermediaries who help the speech of millions and billions of users reach their audiences would face unworkable content moderation requirements that inevitably lead to large scale censorship. The immunity has some important exceptions, including for violations of federal criminal law and intellectual property claims. But the legal immunity’s protections extend to services far beyond social media platforms. Thus everyone who sends an email, makes a Kickstarter, posts on Medium, shares code on Github, protects their site from DDOS attacks with Cloudflare, makes friends on Meetup, or posts on Reddit, benefits from Section 230’s immunity for all intermediaries. 

Section 230 Protects Users Who Create Content: Section 230 directly protects Internet users who themselves act as online intermediaries from being held liable for the content created by others. So when people publish a blog and allow reader comments, for example, Section 230 protects them. This enables Internet users to create their own platforms for others’ speech, such as when an Internet user created the Shitty Media Men list that allowed others to share their own experiences involving harassment and sexual assault. 

The SAFE Tech Act Fails to Capture the Reality of Paid Content Online

In what appears to be an attempt to limit deceptive advertising, the SAFE Tech Act would amend Section 230 to remove the service’s immunity for user-generated content when that content is paid speech. According to the senators, the goal of this change is to stop Section 230 from applying to ads, “ensuring that platforms cannot continue to profit as their services are used to target vulnerable consumers with ads enabling frauds and scams.” 

With this change, even if the defendant ultimately prevails against a plaintiff’s claims, they will have to defend themselves in court for longer, driving up their costs.

But the language in the bill is much broader than just ads. The bill says Section 230’s platform immunity for user-generated content does not apply if, “the provider or user has accepted payment to make the speech available or, in whole or in part, created or funded the creation of the speech.” Much, much more of the Internet is likely included behind this definition than advertising, and it is unclear how much paid or sponsored content this language would sweep up. This change would undoubtedly force a massive, and dangerous, overhaul to Internet services at every level. 

Although much of the legislative conversation around Section 230 reform focuses on the dominant social media services that are generally free to users, most of the intermediaries people rely on involve some form of payment or monetization: from more obvious content that sits behind a paywall on sites like Patreon, to websites that pay for hosting from providers like GoDaddy, to the comment section of a newspaper only available to subscribers. If all companies that host speech online and whose businesses depend on user payments lose Section 230 protections, the relationship between users and many intermediaries will change significantly, in several unintended ways:

Harm to Data Privacy: Services that previously accepted payments from users may decide to change to a different business model based on collecting and selling users’ personal information. So in seeking to regulate advertising, the SAFE TECH Act may perversely expand the private surveillance business model to other parts of the Internet, just so those services can continue to maintain Section 230’s protections. 

Increased Censorship: Those businesses that continue to accept payments will have to make new decisions about what speech they can risk hosting and how they vet users and screen their content. They would be forced to monitor and filter all content that appears whenever money has exchanged hands—a dangerous and unworkable solution that would find much important speech disappeared, and would turn everyone from web hosts to online newspapers into censors. The only other alternative—not hosting user speech—would also not be a step forward. 

As we’ve said many times, censorship has been shown to amplify existing imbalances in society. History shows us that when faced with the prospect of having to defend lawsuits, online services (like offline intermediaries before them) will opt to remove and reject user speech rather than try to defend it, even when it is strongly defensible. These decisions, as history has shown us, are applied disproportionately against the speech of marginalized speakers. Immunity, like that provided by Section 230, alleviates that prospect of having to defend such lawsuits. 

Unintended Burdens on a Complex Ecosystem: While minimizing dangerous or deceptive advertising may be a worthy goal, and even if the SAFE Tech Act were narrowed to target ads in particular, it would not only burden sites like Facebook that function as massive online advertising ecosystems; it would also burden the numerous companies that comprise the complex online advertising ecosystem. There are numerous intermediaries between the user seeing an ad on a website and the ad going up. It is unclear which companies would lose Section 230 immunity under the SAFE TECH Act; arguably it would be all of them. The bill doesn’t reflect or account for the complex ways that publishers, advertisers, and scores of middlemen actually exchange money in today’s online ad ecosystem, which happens often in a split second through Real-Time Bidding protocols. It also doesn’t account for more nuanced advertising regimes. For example, how would an Instagram influencer—someone who is paid by a company to share information about a product—be affected by this loss of immunity? No money has exchanged hands with Instagram, and therefore one can imagine influencers and other more covert forms of advertising becoming the norm to protect advertisers and platforms from liability. 

For a change in Section 230 to work as intended and not spiral into a mass of unintended consequences, legislators need to have a greater understanding of the Internet ecosystem of paid and content, and the language needs to be more specifically and narrowly tailored.

The Danger That an Affirmative Defense Requirement Creates 

The SAFE Tech Act also would alter the legal procedure around when Section 230’s immunity for user-generated content would apply in a way that would have massive practical consequences for users’ speech. Many people upset about user-generated content online bring cases against platforms, hosts, and other online intermediaries. Congressman Devin Nunes’ repeated lawsuits against Twitter for its users’ speech are a prime example of this phenomenon. 

The increased legal costs of even meritless lawsuits will have serious consequences for users’ speech. 

Under current law, Section 230 operates as a procedural fast-lane for online services—and users who publish another user’s content—to get rid of frivolous lawsuits. Platforms and users subjected to these lawsuits can move to dismiss the cases before having to even respond to the legal complaint or going through the often expensive fact-gathering portion of a case, known as discovery. Right now, if it’s clear from the face of a legal complaint that the underlying allegations are based on a third party’s content, the statute’s immunity requires that the case against the platform or user who hosted the complained-of content be dismissed. Of course, this has not stopped plaintiffs from bringing (often unmeritorious) lawsuits in the first place. But in those cases, Section 230 minimizes the work the court must go through to grant a motion to dismiss the case, and minimizes costs for the defendant. This protects not only platforms but users; it is the desire to avoid litigation costs that leads intermediaries to default to censoring user speech.

The SAFE Tech Act would subject both provider and user defendants to much more protracted and expensive litigation before a case could be dismissed. By downgrading Section 230’s immunity to an “affirmative defense … that an interactive computer service provider has a burden of proving by a preponderance of the evidence,” defendants could no longer use Section 230 to dismiss cases at the beginning of a suit and would be required to prove—with evidence—that Section 230 applies. Right now, Section 230 saves companies and users significant legal costs when they are subjected to frivolous lawsuits. With this change, even if the defendant ultimately prevails against a plaintiff’s claims, they will have to defend themselves in court for longer, driving up their costs.

The increased legal costs of even meritless lawsuits will have serious consequences for users’ speech. An online service that cannot quickly get out of frivolous litigation based on user-generated content is likely going to take steps to prevent such content from becoming a target of litigation in the first place, including screening user’s speech or prohibiting certain types of speech entirely. And in the event that someone upset by a user’s speech sends a legal threat to an intermediary, the service is likely to be much more willing to remove the speech—even when it knows the speech cannot be subject to legal liability—just to avoid the new, larger expense and time to defend against the lawsuit.

As a result, the SAFE Tech Act would open the door for a host of new suits that by design are not filed to vindicate a legal wrong but simply to remove certain speech from the Internet—also called SLAPP lawsuits. These would remove a much greater volume of speech that does not, in fact, violate the law. Large services may find ways to absorb these new costs. But for small intermediaries and growing platforms that may be competing with those large companies, a single costly lawsuit, even if the defendant small company eventually prevails, may be the difference between success and failure. This is not to mention the many small businesses who use social media to market their company or service to respond to (and moderate) comments on their pages or sites, and who would likely be in danger of losing immunity from liability under this change. 

No Guardrails Around Injunctive Relief Would Open the Door to Dangerous Takedowns

The SAFE Tech Act also modifies Section 230’s immunity in another significant way, by permitting aggrieved individuals to seek non-monetary relief from platforms whose content has harmed them. Under the bill, Section 230 would not apply when a plaintiff seeks injunctive relief to require an online service to remove or restrict user-generated content that is “likely to cause irreparable harm.” 

The SAFE Tech Act’s injunctive relief carveout fails to account for how the provision will be misused to suppress lawful speech.

This extremely broad change may be designed to address a legitimate concern about Section 230. Some people who are harmed online simply want the speech taken down instead of seeking monetary compensation. While giving certain Internet users an effective remedy that they currently lack under 230, the SAFE Tech Act’s injunctive relief carveout fails to account for how the provision will be misused to suppress lawful speech.

The SAFE Tech Act’s language appears to permit enforcement of all types of injunctive relief at any stage in a case. Litigants often seek emergency and temporary injunctive relief at an extremely early stage of the case, and judges frequently grant it without giving the speaker or platform an opportunity to respond. Courts already issue these kinds of takedown orders against online platforms, and they are prior restraints in violation of the First Amendment. If Section 230 does not bar these types of preliminary takedown orders, plaintiffs are likely to misuse the legal system to force down legal content without a final adjudication about the actual legality of the user-generated content.

Also, the injunctive relief carveout could be abused in another type of case, known as a default judgment, to remove speech without any judicial determination that the content is illegal. Default judgments are when the defendant does not fight the case, allowing the plaintiff to win without any examination of the underlying merits. In many cases, defendants avoid litigation simply because they don’t have the time or money for it. 

Because of its one-sided nature, default judgments are subject to great fraud and abuse. Others have documented the growing phenomenon of fraudulent default judgments, typically involving defamation claims, in which a meritless lawsuit is crafted for the specific purpose of getting a default judgment and to avoid a consideration of its merits. If the SAFE Tech Act were to become law, fraudulent lawsuits like these would be incentivized and become more common, because Section 230 would no longer provide a barrier against their use to legally compel intermediaries to remove lawful speech.

A recent Section 230 case called Hassel v. Bird illustrates how a broad injunctive relief carveout to the law that would apply to default judgments would incentivize censorship of protected user speech. In Hassel, a lawyer sued a user of Yelp (Bird) who gave her law office a bad review, claiming defamation. The court never ruled on whether the speech was defamatory, but because the reviewer did not defend the lawsuit, the trial judge entered a default judgment against the reviewer, ordering the removal of the post.  Section 230 prevented a court from ordering Yelp to remove the post. 

Despite the potential for litigants to abuse the SAFE Tech Act’s injunctive relief carveout, the bill contains no guardrails for online intermediaries hosting legitimate speech targeted for removal. As it stands, the injunctive relief exception to Section 230 poses a real danger to legitimate speech. 

In Conclusion, For Safer Tech, Look Beyond Section 230

This only scratches the surface of the SAFE Tech Act. But the bill’s shotgun approach to amending Section 230, and the broadness of its language, make it impossible to support as it stands. 

If legislators take issue with deceptive advertisers, they should use existing laws to protect users from them. Instead of making sweeping changes to Section 230, they should update antitrust law to stop the flood of mergers and acquisitions that have made competition in Big Tech an illusion, creating much of the problems we see in the first place. If they want to make Big Tech more responsive to the concerns of consumers, they should pass a strong consumer data privacy law with a robust private right of action.

If they disagree with the way that large companies like Facebook benefit from Section 230, they should carefully consider that changes to Section 230 will mostly burden smaller platforms and entrench the large companies that can absorb or adapt to the new legal landscape (large companies continue to support amendments to Section 230, even as those companies simultaneously push back against substantive changes that actually seek to protect users, and therefore harm their bottom line). Addressing Big Tech’s surveillance-based business models can’t, and shouldn’t, be done through amendments to Section 230—but that doesn’t mean it shouldn’t be done at all. 

It’s absolutely a problem that just a few tech companies wield such immense control over what speakers and messages are allowed online. And it’s a problem that those same companies fail to enforce their own policies consistently or offer users meaningful opportunities to appeal bad moderation decisions. But this bill would not create a fairer system.

Coded Resistance: Freedom Fighting and Communication

It’s nearing the end of Black History Month, and that history is inherently tied to strife, resistance, and organizing related to government surveillance and oppression. Even though programs like COINTELPRO are more well-known now, the other side of these kinds of stories are the ways the Black community has fought back through intricate networks and communication aimed at avoiding surveillance.

The Borderland Network

The Trans-Atlantic Slave Trade was as a dark, cruel time in the history of much of the Americas. The horrors of slavery still casts their shadow through systemic racism today. One of the biggest obstacles enslaved Africans faced when trying to organize and fight was the fact that they were closely watched, along with being separated, abused, tortured, and brought onto a foreign land to work until their death for free. They often spoke different languages from each other, with different cultures, and beliefs. Organizing under these conditions seemed impossible. Yet even under these conditions including overbearing surveillance, they developed a way to fight back. Much of this is attributed to the brilliance of these Africans using everything they had to develop communications with each other under chattel slavery. The continued fight today reflects much of the history that was established from dealing with censorship and authoritarian surveillance.

As Sylvane Diouf chronicled in the book, Slavery’s Exiles, slavery was not only catastrophic for many Africans, but also thankfully never a peaceful time for white owners and overseers either. Those captured from Africa and brought to the Americas seldom gave their captors a night of rest. Through rebellion, resistance, and individual sabotage with everyday life during this horrible period, freedom remained an objective. And with that objective came a deep history of secret communications and cunning intelligence.

Runaways often returned to plantations at night for years unnoticed and undetected, mostly to stay connected to family or relay information. One married couple, as Diouf tells it,  had a simple yet effective signaling system where the wife placed a garment in a particular spot that was visible from her husband’s covert. Ben and his wife (whose name is unknown) had other systems in place if it was too dark to see. For example, shining a bright light through the cracks in their cabin for an instant, and then repeating it at intervals of two or three minutes, three or four times.

These close-proximity runaways were deemed “Borderland Maroons”. They’d create tight networks of communication from plantation to plantation. Information, like the amount of reward for capture and punishment, traveled quickly through the grapevine of the Borderland Maroons. Based on this intelligence, many would make plans around either traveling away completely or staying around longer to gather others. Former Georgia Delegates from the Continental Congress recounted:

“The negroes have a wonderful art of communicating intelligence among themselves” it will run several hundred miles in a week or fortnight”

These networks often gained runaways years out of captivity and thus the ability to maintain a network among the enslaved. Coachmen, draymen, boatmen, and others who were allowed to move around off plantations were the backbone for this chain of intelligence. The shadow network of the Borderlands was the entry point of organizing for potential runaways. So even if someone was captured, they could tap into this network again later. No one would be getting rest or sleep. As Diouf recounts, keeping a high level of surveillance took a lot of resources from the slaveholders, and that fact was well-exploited by the enslaved.

Moses

Perhaps the most famous artisan of secret communications during this period is the venerable Harriet Tubman. Her character and will is undisputed, and her impeccable timing and remarkable intuition strengthened the Underground Railroad.

Dr. Bryan Walls notes much of her written and verbal communication was through plain language that acted as a metaphor:

  • “tracks” (routes fixed by abolitionist sympathizers)
  • “stations” or “depots” (hiding places)
  • “conductors” (guides on the Underground Railroad)
  • “agents” (sympathizers who helped the slaves connect to the Railroad)
  • “station masters” (those who hid slaves in their homes)
  • “passengers,” “cargo,” “fleece,” or “freight” (escaped slaves)
  • “tickets” (indicated that slaves were traveling on the Railroad)
  • “stockholders” (financial supporters who donated to the Railroad)
  • “the drinking gourd” (the Big Dipper constellation—a star in this constellation pointed to the North Star, located on the end of the Little Dipper’s handle)

The most famous example of verbal communication on plantations was the usage of song. The tradition of verbal history and storytelling remained strong among the enslaved, and acted as a way to “hide in plain sight”. Tubman said she changed the tempo of the songs to indicate whether it was safe to come out or not.

Harriet Tubman’s famous claim is “she never lost a passenger.” This rang true not only as she freed others, but also when she acted as a spy during the Civil War aiding the Union. As the first and only woman to organize and lead a military operation during the Civil War, her reputation was solidified as an expert in espionage. Her information was so detailed and accurate it often saved Black troops in the Union from harm.

Many of these tactics won’t be found written down, but passed verbally. It was illegal or prohibited for Black people to read and write. Therefore, it was a lethal risk to write more traditional ciphertext as communications.

Language as Resistance

Even though language was a barrier in the beginning and written communication was out of the question, over time English was forced onto enslaved Africans and many found a way to each other by creating an entirely new language on their own—Creole. There are many different kinds of Creole across the African Diaspora, which served as not only a way to communicate and develop a “home” language-wise, but also a way to communicate information to each other under the eyes of overseers.

Coded Resistance in the African Diaspora

Of course, resistance against slavery didn’t just occur in the U.S., but also in Central and South America. Under domineering surveillance, many tactics had to be devised quickly and planned under the eye of white supremacy. Quilombos, or what can be viewed as the “Maroons” of Brazil, developed a way to fight against the Portuguese rule of that time:

“Prohibited from celebrating their cultural customs and strictly forbidden from practicing any martial arts, capoeira is thought to have emerged as a way to bypass these two imposing laws.” – Disguised in Dance: The Secret History of Capoeira

The rebellions in Jamaica, Haiti, and Mexico had extensive planning. They were not, as they are sometimes portrayed, merely the product of spontaneous and rightful rage against their oppressors. Some rebellions, such as Tacky’s War in Jamaica, were documented to be in the works for over a year before the first strike.

Modern Communication, Subversion, and Circumvention

Radio

As technology progressed, the oppressed adapted. During the height of the Civil Rights Movement, radio became an integral part of informing supporters of the movement. While churches may have been centers of gathering outside of worship, the radio was present even in these churches to give signals and other vital info. As Brian Ward notes in Radio and the Struggle for Civil Rights in the South, this info was conveyed in covert ways as well. Such as reporting traffic jams to indicate police roadblocks.

Radio made information accessible to those who could not afford newspapers or who were denied access to literacy education due to Jim Crow. Black DJs relayed information about protests, misinformation, and police checkpoints. Keeping the community informed and as safe as possible became these DJ’s mission outside of music and propelled them into civic engagement, from protest to walking new Black voters through the voting procedure and system. Radio became a central place to enter a different world past Jim Crow.

WATS Phone Lines

Wide Area Telephone Services (WATS) also became a vital tool for the Civil Rights Movement to disperse information during important moments that often meant life or death. To circumvent the monopolistic Bell System (“Ma Bell”) that only employed white operators and colluded with law enforcement, vital civil rights organizations used WATS phone lines. These numbers were dedicated and paid lines such as 800 numbers. Directly patching through to organizations like the Student Nonviolent Coordinating Committee (SNCC), Congress of Racial Equality (CORE), Council of Federated Organizations (COFO), and the Southern Christian Leadership Conference (SCLC). These organization’s bases had code names to refer to when relaying information to another base either via WATS or radio.

Looking at Today: Reverse Surveillance

While Black and other marginalized communities still struggle to communicate despite surveillance, we do have digital tools to help. With encryption widely available, we can now use protected communications with each other for sensitive information. Of course, not everyone today is free to roam or use these services equally. Encryption itself is also under constant risk of being undermined in different areas of the world. Technology can feel nefarious and “Big Tech” seems to have a constant eye on millions.

In addition, just as with the DJs of the past, current activists like Black Lives Matter are used this hypervisibility under Big Tech to get police brutality highlighted in the mainstream conversation and in real life. The world has seen police brutality up close because of on-site video, live recordings from phones and police scanners. Databases like EFF’s Atlas of Surveillance increasingly map police technology in your city.  And all of us, whether activists or not, can use tools to scan for the probing of communications during protests.

The Black community has been fighting what essentially is the technological militarization of the police force since the 1990s. While the struggle continues, we have seen recent wins where police use of facial recognition technology is now being limited or banned in many areas in the U.S., with support from groups around the country, we can help close this especially dangerous window of surveillance. 

Being able to communicate with each other and organize is embedded in the roots of resistance around the world, but it has a long and important history in the Black community in the United States. Whether online or off, we are keeping a public eye on those who are sworn to serve and protect us, with the hope one day we can freely move without the chains of surveillance and white supremacy. Until then, we’ll continue to see, and to celebrate, the spirit of resistance as well as the creativity of efforts to build and keep a strong line of communication despite surveillance and repression.

Science Proves That Time Is Running Out For Humanity…

Even if we weren’t facing an apocalyptic future of our own making, humanity would still be doomed due to the nightmarish reproductive crisis that we are now facing.  Just about every measure of human fertility that you can measure is dropping precipitously, and this is particularly true in the western world.  As a result, we have vast numbers of young adults that are either infertile or that deeply struggle with fertility issues, and the number of babies born with birth defects has been soaring.  It gets worse with each passing year, and the future for humanity is exceedingly bleak unless we find a way to turn things around.

Dr. Shanna Swan has been closely studying these issues for decades, and she is now warning that the “current state of reproductive affairs can’t continue much longer without threatening human survival”

Sperm counts in Western countries have dropped by more than 50 percent since the 1970s. At the same time, men’s problems with conceiving are going up: Erectile dysfunction is increasing and testosterone levels are declining by 1 percent each year.

“The current state of reproductive affairs can’t continue much longer without threatening human survival,” warns Mount Sinai fertility scientist Dr. Shanna Swan in her book, “Count Down” (Scribner), out Tuesday. “It’s a global existential crisis.”

Sadly, she is not exaggerating one bit.  There is simply no way that the human race will be able to avoid a dramatic population decline if these trends continue.

Previously, Dr. Swan made headlines when she warned that sperm counts dropped by a staggering 59 percent between 1973 and 2011…

In 2017, she sounded the alarm with a meta-analysis of 40,000 men that showed that sperm count fell a whopping 59 percent between 1973 and 2011.

We are already seeing the effects. Worldwide fertility has dropped by 50 percent between 1960 and 2015. The United States has a total birth rate that is 16 percent below what it needs to replace itself. Though there are obvious factors at play (couples are conceiving later and opting to have smaller families), Swan argues that the issues run deeper than personal choice.

What would our planet look like if worldwide fertility plunged by another 50 percent?

Global population growth has already come to a standstill in most areas, and there are some countries that are already starting to experience significant declines.

Men in particular are becoming infertile at a frightening rate.  According to Swan, sperm counts have gotten extremely low

Today the average male is nearing that number at 47.1?million sperm per milliliter. Compare him to his father, who had an average of 99 million sperm per milliliter, and it’s clear that this is a deeply worrying trend.

Once you get below 40 million, it becomes challenging to have a child, and the average male is nearly there already.

So why is this happening?

Well, Dr. Swan is pointing to the prevalence of endocrine disruptors in our society

Swan and other experts say the problem is a class of chemicals called endocrine disruptors, which mimic the body’s hormones and thus fool our cells. This is a particular problem for fetuses as they sexually differentiate early in pregnancy. Endocrine disruptors can wreak reproductive havoc.

These endocrine disruptors are everywhere: plastics, shampoos, cosmetics, cushions, pesticides, canned foods and A.T.M. receipts. They often aren’t on labels and can be difficult to avoid.

In order to completely eliminate endocrine disruptors from your life, you would probably need to drop out of society entirely.

Another scientist at Washington State University has found that exposure to endocrine disruptors can make 20 percent of mice infertile in just three generations

Patricia Ann Hunt, a reproductive geneticist at Washington State University, has conducted experiments on mice showing that the impact of endocrine disruptors is cumulative, generation after generation. When infant mice were exposed for just a few days to endocrine disrupting chemicals, their testes as adults produced fewer sperm, and this incapacity was transmitted to their offspring. While findings from animal studies can’t necessarily be extended to humans, after three generations of these exposures, one-fifth of the male mice were infertile.

Of course there are many other factors that affect fertility as well, and I have covered quite a few of them in previous articles.

The point I am making in this article is that humanity is in very serious trouble, and the only way out is to radically alter our behavior.

But we aren’t going to do that, are we?

In addition to our “fertility collapse”, other research has found that over thousands of years humans have been getting smaller and shorter

An earlier study by Cambridge University found that mankind is shrinking in size significantly.

Experts say humans are past their peak and that modern-day people are 10 percent smaller and shorter than their hunter-gatherer ancestors.

And if that’s not depressing enough, our brains are also smaller.

To me, reading that our brains have been getting smaller was particularly depressing, but that would definitely help to explain the level of competence displayed by some of our political leaders these days.

Our founders wrote such brilliant things, but in our time most Americans are so dumb that they literally cannot understand material written at that level.

We have become a dumbed-down “idiocracy” that thinks that reality television and watching people kick one another in the groin are some of the highest forms of entertainment.

It is frightening to think about how much we have degenerated already, and I don’t even want to imagine what Americans would be like 50 years from now.

Unfortunately, we won’t have to worry about that, because there won’t be an America if we stay on the path that we are currently on.

Of course the clock is ticking for humanity as a whole, and everyone should be able to see that.

But we love our self-destructive behaviors so much that we will never give them up.

So there will be no change of course, and we shall surely reap what we have sown.

If You Believe Life Will “Return To Normal”, You Have A Fundamental Misunderstanding Of The Times In Which We Live

Despite all of the craziness that is going on out there, many pundits are trying to convince us that life will soon “return to normal” and that great days are just around the corner.  They are telling us this despite the fact that the state of Texas has been in a state of collapse this week, the real economy continues to implode, the unemployment numbers are going up, civil unrest continues to rage in our streets on a nightly basis, and our entire planet continues to become even more unstable.  Those that believe that happy days are here again have a fundamental misunderstanding of the times in which we live.  This isn’t a period of time when America is going to “build back better”.  Rather, this is a time when America is going to go even deeper into “the perfect storm”.

One of the reasons why so many on the left are feeling optimistic right now is because the COVID pandemic appears to be subsiding

According to a CNN analysis of data from Johns Hopkins University, the US is seeing a 29% decline in new Covid-19 cases compared to this time last week, the steepest one-week decline the US has seen during the pandemic.

Improvements have been made; in a White House briefing Friday, US Centers for Disease Control and Prevention Director Dr. Rochelle Walensky said the US continues to see a five-week decline, with the seven-day average of cases declining 69% since peaking on January 11.

We are being told that if the numbers continue to plummet like this, soon there won’t be a need for masks, social distancing and other restrictive measures any longer.

In fact, James Hamblin says that there is a possibility that “pre-pandemic life will return even before summer is upon us”

If all of this holds true, it would mean that many aspects of pre-pandemic life will return even before summer is upon us. Because case numbers guide local policies, much of the country could soon have reason to lift many or even most restrictions on distancing, gathering, and masking. Pre-pandemic norms could return to schools, churches, and restaurants. Sports, theater, and cultural events could resume. People could travel and dance indoors and hug grandparents, their own or others’. In most of the U.S., the summer could feel … “normal.”

But is this pandemic really over, or is it just transitioning into a new chapter?

According to the Daily Mail, the number of confirmed cases of “Super COVID” in the United States is now doubling every 10 days…

There are now more than 1,600 cases of the UK’s B117 ‘super covid’ variant in the US, according to a DailyMail.com analysis. Cases are doubling approximately every 10 days, according to a recent Scripps Research Institute study.

‘Super covid’ cases have exploded in two states that took opposite approaches to the pandemic: California, which has been under some of the nation’s strictest lockdowns, and Florida which has never had a mask mandate.

Cases of the 70 percent more infectious variant have exploded to 433 in Florida, in less than one month since the first case was discovered there.

Of course many experts are far more concerned about the new COVID variants that have emerged in Brazil and South Africa.  Both of those variants have now made it to the U.S., and we already know that the current vaccines don’t work very well against the South African variant.

Meanwhile, the U.S. economy continues to crumble right in front of our eyes.

On Thursday, we learned that another 861,000 Americans filed new claims for unemployment benefits last week…

Last week’s initial jobless claims soared to 861,000, despite more states and cities lifting restrictive business measures amid a decline in the number of coronavirus cases. Economists had predicted around 773,000 first-time claims for the week ended Feb. 13. Data for the previous week was revised up to 848,000 from 793,000.

Unemployment claims have been at catastrophic levels for nearly a year, and now they are starting to surge higher once again.

We also just learned that a whopping 92 percent of all restaurants in New York City “could not afford to pay their rent in December”

A new report from the NYC Hospitality Alliance shows the extreme financial problems restaurants in New York City are facing, as 92% of the city’s restaurants could not afford to pay their rent in December.

The number has steadily worsened throughout the pandemic, from 80% of restaurants in June 2020 not being able to pay rent.

That isn’t what a “recession” looks like.

The truth is that we are in an economic depression, and there is no end in sight.

At the same time, communities all over the U.S. continue to be plagued by civil unrest and crime.

In cities such as Seattle, violent protests and riots have essentially become a nightly occurrence at this point.  But most of the violence that we are witnessing is old-fashioned crime.  One study found that murder rates in major U.S. cities were up by an average of 30 percent last year, and the chaos has continued into 2021.  If you want to see an example of the lawlessness that is prevailing in our urban areas right now, just watch this video.

On top of everything else, our entire planet continues to behave in very unusual ways.

For instance, on Friday morning there was a magnitude 4.2 earthquake in Oklahoma

4.2-magnitude earthquake shook Oklahoma and Kansas Friday morning, the U.S. Geological Survey reports.

The 4.3-mile deep quake hit near Manchester, Oklahoma, at 7:56 a.m. CST, according to the USGS. Manchester is in northern Oklahoma near the state’s border with Kansas.

It is not normal to see earthquakes of that size in the middle of the country, but of course we are moving into times when all of the old rules will no longer apply.

Earlier this month, I wrote an article about how volcanoes all along the Ring of Fire have been “starting to pop off like firecrackers”.  I believe that we have entered a time when we will see natural disasters become increasingly frequent and increasingly powerful, and despite all of our advanced technology we are exceedingly vulnerable.

Just look at what just took place in Texas.  A single wave of cold weather plunged the state into a nightmare scenario.

If cold weather can cause this much chaos in Texas, what would a much more severe long-term emergency mean for our entire nation?

The events of the past week should be a wake up call for all of us, because the road ahead is certainly not going to get any easier.

20 Absolutely Horrible Things That The Left Said About Rush Limbaugh Right After He Died

I know that most Americans don’t understand much about etiquette these days, but I still expected better than this.  When someone passes away, it is customary to say positive things about the deceased.  If you can’t find anything positive to say, then you should say nothing at all.  At one time, it would have been considered to be extremely rude to make bitter and nasty comments about someone that has just died, but in America today people just do whatever they feel like doing.  Proper etiquette is a thing of the past, and at this point we have essentially become a nation of degenerate “pig people” that have no respect for anyone or anything.

The first time I ever encountered Rush Limbaugh was when my father started listening to him all the way back in the 1980s.  Rush was a lot more brash and cocky back then, but the one constant throughout the years was his deep, abiding love for America.  He truly loved the United States, our founders, our Constitution and everything that this country was supposed to represent.  He was constantly pushing us to live up to our ideals, and he was not afraid to call out politicians in both parties that he felt were betraying our values.

Over the years he got older, but he also got wiser.  Every time I listened to him I came away with something that would stick with me, and I am very thankful for that.

He was truly great at what he did, and his work has had an impact on hundreds of millions of people.

How many of us will be able to say the same thing when our lives on this planet are through?

Of course many on the left deeply hated Rush Limbaugh and everything that he stood for, and we all understand that.

But couldn’t they have waited at least a few days before viciously trashing his life and his legacy?

David Cross: “Cancer killed the cancer”

George Takei: “I guess I’m grateful that he lived long enough to see Trump defeated by Biden.”

Nathan Bernard: “goodbye Rush Limbaugh, may you rot in hell with your ******* ugly ties”

New York Times podcast host Jane Coaston: “Rush Limbaugh was the first person I ever recognized existed largely as a Rorschach test.”

Palmer Report: “Rush Limbaugh spent decades advancing his career by opportunistically spreading vicious lies that got a lot of bad people elected, whose corrupt policies in turn got a lot of Americans killed.”

Cameron Kasky: “Rush Limbaugh has passed on, but worry not- his memory lives on through bigots everywhere”

Now The Government Is Going To Start Treating Domestic “Extremists” The Same As ISIS Or Al-Qaeda Terrorists

Many Americans were perfectly fine with Islamic terrorists being shipped off to Guantanamo Bay where they would be endlessly waterboarded and tortured in countless other ways.  But now members of Congress are talking about “applying the same penalties” to domestic “extremists” here in the United States.  Does that mean that American citizens will soon be grabbed off the streets and sent to prison camps indefinitely without a trial?  Personally, I am very much against terrorism wherever it is found all over the globe, but what some of our politicians are proposing to do to fight “domestic extremism” goes way over the line.  Once you are done reading this article, I believe that you will share my concerns.

Even before the last election, the Department of Homeland Security was putting out some very alarming statements.  For example, last October DHS officials came to the conclusion that U.S.-based extremists are now “the primary terrorist threat inside the United States”

The primary terrorist threat inside the United States will stem from lone offenders and small cells of individuals,” said the department’s first Homeland Threat Assessment. “Some U.S.-based violent extremists have capitalized on increased social and political tensions in 2020, which will drive an elevated threat environment at least through early 2021.”

If DHS officials had been referring to the groups that have been rioting, looting and burning our cities for the past 12 months, that assessment would make a lot of sense.

But of course that was not who they were talking about.

Following the election, we witnessed the horrific attack on the U.S. Capitol on January 6th.  In the aftermath of that attack, Democrats in Congress have been “insisting that domestic terrorism has eclipsed the threat from foreign actors such as the Islamic State and al-Qaeda”

The attack has left many lawmakers, and especially Democrats, insisting that domestic terrorism has eclipsed the threat from foreign actors such as the Islamic State and al-Qaeda. DHS and its agencies are responsible for securing the country’s borders, ports, transportation and cyber systems, generally leaving the monitoring of extremist groups and terrorism investigations to the FBI. But DHS and its agencies have nearly eight times as many employees as the FBI, and calls for the department to play a more muscular role in combating domestic extremism have policymakers looking at new ways to enlist its resources.

Once again, these Democrats are not talking about the groups that attack police stations, courthouses and federal buildings on an almost nightly basis.

Instead, their focus is almost exclusively on those that have “far right” political views.

Democrat Tulsi Gabbard is warning that her colleagues in Congress intend to define “extremist” so broadly that it could apply to nearly half the country

“What characteristics are we looking for as we are building this profile of a potential extremist, what are we talking about? Religious extremists, are we talking about Christiansevangelical Christians, what is a religious extremist? Is it somebody who is pro-life? Where do you take this?” Gabbard said.

She said the proposed legislation could create “a very dangerous undermining of our civil liberties, our freedoms in our Constitution, and a targeting of almost half of the country.”

Last month, I wrote an article about the new bill that she was talking about.  It is called the Domestic Terrorism Prevention Act of 2021, and it is basically the Patriot Act on steroids.

Of course it won’t be used against terrorists on the left.  During a recent discussion about domestic extremism, Democrat Bennie Thompson (who is the chairman of the House Homeland Security Committee) specifically used the word “patriots” to describe the sort of person that he intends to target…

“A lot of them mask themselves under some guise of being patriots or some form of citizen, but the question is, what do they advocate?”

That statement should chill you to the core.

“Republican” Michael McCaul, who is also on the House Homeland Security Committee, has gone even farther.

If you can believe it, he is actually suggesting that domestic extremists should face “the same penalties as those that exist for terrorism that originates overseas”

Rep. Michael McCaul (R-Tex.), the committee’s former chairman, joined lawmakers calling for specific federal sanctions for domestic terrorism, potentially applying the same penalties as those that exist for terrorism that originates overseas. Such legislation could include penalties for providing material support to domestic groups and laws holding technology companies responsible for violent and extremist content on their platforms.

“I think it sends a strong message about where Congress is that we’re going to treat domestic terrorism on an equal plane as international terrorism,” McCaul said.

So what happens to terrorists overseas?

They are ruthlessly gunned down, their homes are hit by unexpected drone strikes, or if they are really lucky they get hauled off to Guantanamo Bay.

Without a doubt, terrorism has no place in our society.

And if authorities really wanted to do something about it, they should arrest the terrorists that are endlessly committing violence in Seattle, Portland and other major cities.

But whenever an American citizen is arrested, it is imperative that every constitutional right is respected and that citizen is given a fair trial.

Sadly, the measures that some members of Congress are now proposing cross quite a few lines that should never, ever be crossed.

Detaining U.S. citizens indefinitely without a trial is something that should never, ever be done.

Sending drones to “take out” U.S. citizens simply because of what they believe is something that should never, ever be done.

And torturing U.S. citizens in the name of “fighting extremism” is something that should never, ever be done.

All of these things have been done to ISIS and Al-Qaeda terrorists, and now members of Congress want “domestic extremists” to be treated the same way.

Since the definition of a “domestic extremist” now covers close to half the country, there is a very good chance that you could potentially be considered a “domestic extremist” too.

We have reached such a critical turning point in our history, and we really are on the verge of losing all of our precious constitutional rights.

The Reason Why A Lot Of People Are Leaving San Francisco Might Surprise You

Over the past year we have seen a mass exodus from major cities along the west coast, but what is happening to San Francisco is particularly sad.  Once upon a time, San Francisco was one of the most beautiful cities on the entire planet.  There is so much culture there, and the rolling hills make it a place like no other.  And thanks to the tech boom in Silicon Valley, it has become one of the most prosperous cities in the whole country.  So why have hordes of San Francisco residents decided to leave and never look back?

Well, there are a lot of factors at work.

First of all, the cost of living has gotten wildly out of control.  A postage stamp of an apartment will cost you thousands of dollars per month to rent, and a lot of people don’t like paying 17 dollars for a salad.

For others, the extremely high taxes and the insane politicians are more than enough of a reason to leave the state.  The lockdowns that were instituted by Governor Gavin Newsom have destroyed thousands of small businesses, and many former small business owners have pledged that they will never go back to California under any circumstances.

In San Francisco in particular, open drug abuse in the streets has made headlines all over the globe in recent years.  The streets are constantly littered with drug needles and piles of human feces, and that isn’t pleasant.

On top of everything else, there is always the threat of more wildfires and a giant earthquake could strike the coast at literally any moment.

But none of those things are what this article is about.

This article is about the huge spike in crime that is driving countless people away from San Francisco.

When he was able to get a job with a tech company four years ago, Kieran Blubaugh jumped at the chance to live in San Francisco, and at first everything seemed great

Kieran Blubaugh dreamed of living in California when he was growing up in Indiana. He played the Tony Hawk Pro Skater video game and envisioned himself skateboarding down San Francisco’s crazy hills.

After paying off his student loans four years ago, he landed a job with a tech company and moved to San Francisco. At first, life was heavenly. He had a seven-minute commute on his motorcycle. He could pay $30 to see Incubus, one of his favorite bands, a short walk from his apartment.

Unfortunately, his infatuation with the region did not last long.

Even though he was located in a good part of the city, crime just kept getting worse and worse, and eventually he decided that enough was enough

Soon, however, his California dream soured. Thieves broke into his locked garage and did $8,000 worth of damage to his motorcycle, doubling his insurance rates. His dog nearly died after eating human feces on the sidewalk. Seeing people either getting arrested or being treated for an overdose outside a nearby building was a regular occurrence.

“And I live in a nice part of town,” said Blubaugh, 33.

With each passing year, the criminals just keep becoming even more brazen.

Not too long ago, San Francisco resident Ben Couillard had someone watch his house while he was away, and that individual actually had to confront someone that was trying to break into the house

He said the house sitter came face-to-face with the suspicious person who had turned his attention away from the vehicles and to the house.

“So she saw him through the window and basically when she asked him, you know, ‘Can I help you?’ Like, what are you doing as he’s trying to break in? And he said to her, like, ‘Go upstairs, (expletive) or I’ll kill you.”

What would you do if that happened to you?

You could call the San Francisco police, and they may or may not show up eventually.

Meanwhile, the junkies will continue to roam throughout your neighborhood as they search for things to steal so that they can sell them for more drugs.

The other night, San Francisco officials held a “virtual town hall” to discuss the crime wave.  Residents were told that criminals are starting to target residents more frequently because they don’t have many tourists to prey upon these days

San Francisco Supervisor Hillary Ronen, District Attorney Chesa Boudin, and the captain of the police department overseeing the area, held a virtual town hall with residents of the community Wednesday night to address their concerns.

They attribute what they say is an increase in crime to “economic desperation” and “tourism has gone down so substantially in San Francisco that criminal rings that targeted tourists in areas that tourists frequent no longer have tourists there,” said Supervisor Ronen.

Please remind me not to visit San Francisco as a tourist any time soon.

Sadly, we are seeing the exact same thing happen to San Francisco that has happened to countless other communities all across the nation.  Like so many other major cities, it has become a crime-ridden, drug-infested hellhole, and this has happened even though northern California is swimming in hundreds of billions of dollars from the tech industry.

After telling a reporter why he left the state, Kieran Blubaugh was asked how conditions in the state could be improved.  This was his answer

“We need more police. There’s a general lawlessness that’s just scary.”

Isn’t that ironic?

The “defund the police” movement has been pushing California cities such as San Francisco to greatly reduce police funding, but Blubaugh insists that the solution is more police.

And Blubaugh is not exactly an elderly curmudgeon.  In fact, he is just 33 years old.

Of course the phrase “general lawlessness” could be used to describe the condition of the United States as a whole.  We have become an upside down society where good is evil and evil is good, and as a result we have totally lost our way.

Unless we completely reverse course, the “general lawlessness” in our country is only going to intensify in the years ahead.

But we aren’t going to reverse course, are we?

At this point, we appear to have a national love affair with evil, and the consequences of that love affair are going to be very bitter indeed.

3 Things That Were Once Science Fiction That Have Now Become Science Fact

I think that everyone can agree that our world is becoming stranger with each passing day.  As I survey the news on a daily basis, I am absolutely astounded by the bizarre things that I come across.  When I was growing up, our world seemed like such a stable and predictable place, but that is definitely no longer the case.  These days, we are constantly seeing things happen that I never thought that we would actually see, and that includes officials at the Pentagon admitting that they have been testing wreckage from UFO crashes

THE Pentagon has admitted to holding and testing wreckage from UFO crashes in a bombshell Freedom of Information letter, shared with The Sun.

Researcher Anthony Bragalia wrote to the Defense Intelligence Agency (DIA) requesting details of all UFO material, which they hold and results of any tests they had been carrying out on it.

In the old days, government officials would go to great lengths to deny that UFOs existed.

But now apparently all you have to do to find out the truth is submit a FOIA request.

As a child, I was told that UFOs only existed in science fiction movies.  But over the years sightings have become more and more frequent, and it has become clear that people are not just imagining these objects.

And now the government is even admitting that it has studied materials from crashed UFOs that possess “extraordinary capabilities”

In the response, shared with The Sun, the DIA released 154 pages of test results that includes reports on a mysterious “memory” metal called Nitinol, which remembers its original shape when folded.

Bragalia said it was a “stunning admission” from the US government and the documents reveal that some of the retrieved debris possesses “extraordinary capabilities” including the potential to make things invisible or even slow down the speed of light.

So the good news is that we are starting to get some truth about UFOs from the U.S. government.

But the bad news is that many experts that have studied UFOs believe that the intentions of those piloting the craft are not good at all.

Switching gears, governments around the world are now developing “super soldiers” to fight in the wars of the future.

You would expect to read about such a thing in a comic book, but now it is becoming a reality.

In particular, we are being warned that China has actually conducted “human testing” on members of their own military.  The following comes from NBC News

U.S. intelligence shows that China has conducted “human testing” on members of the People’s Liberation Army in hope of developing soldiers with “biologically enhanced capabilities,” the top U.S. intelligence official said Friday.

John Ratcliffe, the director of national intelligence, included the explosive claim in a long Wall Street Journal op-ed in which he made the case that China poses the pre-eminent national security threat to the U.S.

Could you imagine an entire army of men with “super intelligence”, “super speed” and “super strength”?

Thousands of hybrid soldiers that possess powers like Superman or Captain America would definitely be a force to be reckoned with, and that is apparently what China is after.

In pursuit of this goal, China has been conducting extremely strange genetic experiments for many years

In a communist society with unrestrained ambition, researchers are pursuing weird science. What happens when you mix pig and monkey DNA? Chinese experimenters can tell you. How about growing human-like organs in animals? Yes, they have done that as well.

More recently, one scientist in China has been attempting to give human intelligence to a monkey

Bing Su, a Chinese geneticist at the state-run Kunming Institute of Zoology, recently inserted the human MCPH1 gene, which develops the brain, into a monkey. The insertion could make that animal’s intelligence more human than that of lower primates. Su’s next experiment is inserting into monkeys the SRGAP2C gene, related to human intelligence, and the FOXP2 gene, connected to language skills.

Other governments around the world have also been “playing God”, and now that we have gone down this road there will be no going back.

The last thing I want to talk about is the giant science experiment that is being conducted all over the planet right now.

The experimental mRNA shots that people around the world are being given right now were rushed through the development phase at record speed, and most people don’t realize that they actually “hijack your cells”

When Moderna was just finishing its Phase I trial, The Independent wrote about the vaccine and described it this way: “It uses a sequence of genetic RNA material produced in a lab that, when injected into your body, must invade your cells and hijack your cells’ protein-making machinery called ribosomes to produce the viral components that subsequently train your immune system to fight the virus.”

“In this case, Moderna’s mRNA-1273 is programmed to make your cells produce the coronavirus’ infamous coronavirus spike protein that gives the virus its crown-like appearance (corona is crown in Latin) for which it is named,” wrote The Independent.

Authorities insist that there will be no unexpected problems, but could there be a downside to programming our cells to do things that they were never designed to do that they aren’t anticipating?

Sadly, it appears that we are starting to get an answer to that question.

We are now being told that it is “normal” for people to experience severe side effects from these shots, and we are also now being told that it is “normal” for some patients to die.  Here is one example

A 78-year-old Southern California woman died on Friday after receiving the first dose of the COVID-19 vaccine.

The patient got the injection of the Pfizer vaccine around 12 p.m. at the COVID-19 vaccination site located at Cal Poly Pomona, according to Dr. Michael E. Morris, physician director of Kaiser Permanente Southern California’s COVID-19 Vaccination Program.

While waiting in the observation area, she reported feeling discomfort and, while being evaluated by medical personnel, she lost consciousness, Morris said in a statement.

Of course this is not an isolated case.  According to the latest VAERS data, there have been hundreds of deaths in the U.S. so far.

Unfortunately, Dr. Fauci is now telling us that these experimental treatments don’t even work very well against the new South African variant

Fauci, speaking on NBC’s “Meet the Press,” said less is known about the South African variant than the U.K. version, which has proved to be more transmissible than the original version of the virus.

“But we do know that it (the South Africa variant) evades the protection from some of the monoclonal antibodies, and it diminishes somewhat the capability and the effectiveness of the vaccine to block it,” Fauci said. “It doesn’t eliminate it, but it diminishes it by multiple fold.

And we are also being told that even if the whole world embraces the treatments, COVID will “remain with us” indefinitely

The world should be prepared for the coronavirus to continue to circulate long-term despite the roll-out of vaccines, the head of the EU’s ECDC health agency, Andrea Ammon, said on Friday.

‘We should be prepared that it will remain with us,’ the head of the Stockholm-based European Centre for Disease Prevention and Control said in an interview.

So it appears that authorities will want us to “mask up” and practice social distancing for the foreseeable future, and it is just a matter of time before the next pandemic comes along.

If someone had told me what life would be like in 2021 when I was a kid, I would not have believed them.

Our world has become a really crazy place, and the pace of change is only going to accelerate as we move into the future…

When Corporations Become More Powerful Than The Government, Our Definition Of “Big Brother” Needs To Change

Throughout human history, our God-given liberties and freedoms have often been brutally crushed by oppressive governments, and that is still happening all over the world today.  But in our time, an additional threat to our liberties and freedoms has emerged.  Global corporations just continue to get larger and more powerful, and in recent years they have been increasingly using that power to shape society.  This is a very dangerous trend, because in the western world many of the constraints that our national governments are forced to operate under simply do not apply to corporations.  This gives them an enormous amount of leverage, and they are using it.

Here in the United States, the federal government still has a monopoly on power in areas such as border security, national defense and foreign policy.

But when it comes to the things that matter the most in the day to day lives of most Americans, it could be argued that the giant corporations have now become more powerful than the federal government.

For example, our politicians like to brag about how many jobs that they have “created”, but the truth is that they don’t actually create any jobs unless you want to count useless government desk jobs.

Our politicians can help to foster an environment that will be favorable for economic growth, but it is the corporations that really determine whether the economy will grow or not.

In fact, it could be argued that the corporations are the economy at this point.

Over time, it has become increasingly difficult for any American to become truly independent of the corporate system.  Even if you own a small business or you work for yourself, there is a good chance that you depend on the big corporations in many ways.

If you doubt this, just try to “go it on your own” without ever using any corporate products, without ever dealing with a big tech company, and without ever bringing in any income from any corporate source whatsoever.

These days, most of our lives are defined by our corporate overlords.  They decide what job you will have, what your pay will be, what hours you will work and what your health plan will look like.

Beyond that, now many large corporations have decided that there are certain beliefs, opinions and values that their employees are not permitted to have.

By now, you have probably heard that a certain actress was fired by Disney for having opinions that were not acceptable.  That was a very high profile case, but the truth is that this sort of thing is constantly happening all over the country at this point.

As we move into the future, being guilty of “thought crime” is going to eliminate large blocks of people from ever having certain types of jobs.  If you do not pledge fealty to the current version of political correctness, you simply will not be permitted to hold a prominent position in society.

If your beliefs are considered to be “offensive”, you may get to mop the floors for the elite if you are lucky.

Even when you are at home, the elite want to endlessly monitor and control what you do, say and think.  The primary way that they do this is through the Internet, and in recent months they have tightened their control considerably.  The following comes from an opinion piece that was just authored by former U.S. Senator Orrin Hatch

Consider the events of the last month. Social media sites banned the sitting president of the United States from their platforms. A purge of conservative voices on Twitter ensued. Amazon Web Services expunged Parler, a conservative social media site, from the internet. Just days later, YouTube blocked public access to a Senate hearing on COVID-19.

These events confirmed what many of us have long known: true political power no longer resides in Washington, but in Silicon Valley. Big Tech now effectively decides who has the right to speak, who has the right to assemble online and who has the ability to build a business in the digital age. For many Americans, Twitter’s terms of service agreement now has more power over what they can and cannot say in the public square than the First Amendment does.

In the old days, Americans could go to the public square and say anything that they want.

But now the big tech companies are the public square.

Freedom of speech is a thing of the past on the Internet, and more voices are being “deplatformed” with each passing day.

On Wednesday, it was LifeSiteNews

YouTube just completely removed the LifeSiteNews YouTube channel. This isn’t a temporary ban; every single one of our videos is completely gone.

This greatly grieved me, because so many other pro-life voices have already been silenced.  We desperately need those voices, because if we stay on the path that we are currently on, there is no future for America.

On Thursday, Twitter suspended Project Veritas.

Project Veritas would like to continue to share their information in the public square, and I would like to continue to share it with my readers.  In fact, I share Project Veritas videos on The Most Important News all the time.

But Twitter has decided that Project Veritas has become too offensive.

“Cancel culture” has gotten wildly out of control, and it is starting to infect every area of our society.  Here is more from Orrin Hatch

The pattern of “canceling” individuals for social media posts is well established. This can result in deplatforming, termination of employment or—if you’re baseball legend Curt Schilling—even losing your health insurance. We’re used to seeing cancel culture on a micro-scale: a newspaper editor being fired here, a university professor being suspended there. But now, thanks to an assist from Big Tech, we’re seeing cancel culture on a much broader level. Take the mass cancelation of Parler’s more than 10 million users, or growing calls to ban Fox News, Newsmax and other right-leaning channels altogether. If successful, these efforts will shrink the window of acceptable viewpoints in American society until conservatives find themselves on the outside.

As we continue to go down this road, just think about what this would mean for the next generation of Americans.

Children that are guilty of “thought crime” won’t get into good schools, they will never be allowed to have good jobs, they will be shunned by banks and financial institutions, and they will be banned or marginalized by all of the major entities on the Internet.

Basically, they will have to find a way to survive on the fringes of society somehow.

All of this is designed to force people to believe what they are supposed to believe.

In fact, it is dangerous for you to be reading this article right now.

They are always watching everything that you do on the Internet, and expressions of noncompliance are not acceptable in this brave new world that we live in.
